Former sheriff asks for his appeal to be dismissed

FREMONT — Former Sandusky County Sheriff Kyle Overmyer appears to have changed his mind again.Overmyer 42, who is claiming he is "indigent," filed a motion asking that his request to appeal his criminal conviction be dismissed, meaning at this moment he will continue to serve his four year prison sentence."I am writing this letter in reference to case no. 16CR870. I am requesting to withdraw my appeal process. I no longer want to proceed with this process," Overmyer wrote in a letter dated Jan. 19, just two days after he filed his motion to appeal the case with the Sixth District Court of Appeals.The request to dismiss the appeal was received by the local court Feb. 3 and forwarded to visiting judge Patricia Cosgrove.Read more at: Overmyer under fireWatch Overmyer being sentencedOvermyer on Aug. 23 was indicted on 42 charges in a criminal case prosecuted by Delaware County prosecutor Carol O'Brien, acting as special prosecutor.Overmyer pleaded guilty in November to felony drug and theft charges.
