A noticeable absence in the Erie County clerk of courts office has some public officials scratching their heads.

Clerk of courts Barb Johnson is suffering from a serious illness and has been out of the office for months, according to a doctor's note from Erie County coroner Brian Baxter.

Baxter declined to specify the nature of Johnson's illness and also refused to answer questions "about a patient," though the note he provided advised anyone with questions about Johnson to contact him.

The note said Johnson was in a hospital or nursing home from Oct. 12 to Jan. 15.

Taxpayers and many of Johnson's colleagues have been unaware of her whereabouts, and no one can say if she plans to return to her duties full-time.

Johnson has not returned phone messages seeking comment.

"We want to hear from her as to what's going on with her department," Erie County commissioner Bill Monaghan said. "Her department is a very vital part within county government, and it affects a lot of people."

Over the past few weeks, Johnson has briefly visited her office to complete various tasks while recovering from her illness, said Betty Martin, the county employee temporarily in charge of Johnson's office during her extended absence.

By law, Erie County's elected officials can be entirely absent from office for up to 90 days. They can also receive an additional 40 days of absence if they have a doctor's note proving they're ill, said Gary Lickfelt, the county's attorney.

A number of county officials have speculated, meanwhile, that ousted Erie County auditor Tom Paul could be appointed as Johnson's successor.

I see the SR had a thumbs up to the Erie County Common Pleas Court Judge Tygh Tone for insisting that banks follow the letter of the law in foreclosure proceedings and another thumbs up to attorney Dan McGookey for presenting the evidence that got four foreclosures tossed out of court.

Considering all the hundreds of foreclosures in Erie County over the last 5-8 years I guess getting 4 of them tossed out of court is a pretty good ratio. I also would be curious to know if Citizens Bank, who I believe McGookey is the attorney for, was one of the 4.

Bet not.

Who was responsible for providing the former home of the Erie County prosecutor's office and the former drug task force to Johnson for off site storage? Besides Johnson and her staff, who else has access to this off site storage of records?  If Johnson was not responsible for selecting that off site building, who was? Would the Sandusky Register know? Somebody knows but nobody is talking.

People in Erie County might not like what's going on in the Clerk of Courts office but I know some crook attorneys that sure do ---- in fact, the Common Pleas Court (one anyway) does also. They can get away with a lot of illegal crap when it comes to that office for the simple reason Johnson is never there to oversee what's going on. There's also a certain employee in that office that I wouldn't trust as far as I can see her.

These public records are not on microfilm either so if they are somehow accidently destroyed there is no way to replace them let alone retrieve something someone may need in the future.  Not only do these records need to get online but they need to be sent to the county microfilm department so they can be filmed and made into permanent archival records.

According to Clerk of Court Watch, they list the following: 

Total Number of Counties with records on line: 57 or 64 %

Total Number of Counties without records on line: 32 or 36 %

These stats are 2 years old, so they may have changed slightly.

The sky might be falling but Julie R made some good points, except Barb Johnson's office had been a mess far before the 4th judge.  Barb Johnson has been given a free pass for years long before her current health problems.  As for contacting her "supervisor" she is an elected official, her supervisor is the voters.

When Erie County claimed they needed a 4th judge to help with the backlog of cases supposedly left behind by Judge Maschari, didn't Erie County say it wasn't going to cost the taxpayers anything? Didn't they say that Tone and Binette were going to share one Court? Considering how they both got their own Courts obviously that sure was a lie. Didn't somebody even say that Binette was given two magistrates compared to Tone, who only got one? Didn't somebody also say that the judges gave their staff 30% raises right after the election? 

So when was the Clerk of Courts office moved to the very small office on the 1st floor? Wasn't that right after the election? Considering how the Clerk of Courts was given the added responsibility of an extra judge that sure was a stupid move. 

That said, according to Centauri's comment the stored court documents from Johnson's office (obviously stored right after the move to the small office on the 1st floor) are in the former home of the Erie County prosecutor's office and the former drug task force ------  so I would have to say it sure doesn't take a rocket scientist to see who the two people in the county are that are responsible for providing the room for this off site storage of court documents. Binette was the head of the former drug task force, wasn't he?

If Erie County Commissioner, Bill Monaghan, wants to know what is going on in Ms. Johnson's Department, then why doesn't he contact her supervisor? -she's under no obligation to explain to anyone, except her supervisor,  if she's on an approved FMLA or LOA.   If the Commissioners ARE her supervisors, then just who approved the FMLA?   

Regarding Dr. Baxter's letter  - this appears it's from her file that probably was required to approve the FMLA.  It was faxed FROM the Erie County Commissioners number, 627-7692, on 2/8/11, according to the fax information at the top of the letter. Page 1 was probably the fax cover sheet to whomever it was faxed.  Seems like the Erie County Commissioners office may be guilty of releasing Ms. Johnson's PHI.

 FMLA is only the business of the employee and her Supervisor(s). She shouldn't have to answer to anyone. Her Supervisor(s) should be contacted, since she is a public employee,  to "confirm" it only.  And anyone familar with Hippa, understands neither Dr. Baxter, nor his staff, are permitted to release ANY information. To do so, would mean a lawsuit and a Hippa Compliance investigation.

Being the head of your department and have not done your elected job since October 12th here's a thought that maybe you've heard before but seem to ignore.

LEAD, FOLLOW, OR GET OUT OF THE WAY!!!

I hate to tell you Barb but it is way past time to GET OUT OF THE WAY since it's obvious you are not leading with your absense. Admit you are not able to do the job and move on.

Also a note to county officials. Tom Paul was booted from office for a reason so WHY hand him another department to mess up further? There are other people in this county that could do and excellent job with no political axes to grind. Use your heads for once.

Darkhorse (first commentary in this blog) is absolutely right.  It’s easy to say what should be done in the way of “logic”. However, logic sense isn’t always legal.  In fact, nobody can discuss her condition legally. They can, legally indicate when she is going to return…if…it is necessary to job related functions.  Yes, we know people in the workplace sometimes stand around the coffeepot and ask when someone is returning to work…why they aren’t there…and we think it’s our business to know.  It is not our business (even though the curiously may be eating us up) to know the medical reason why a person is out.  It would be our business to know when the return to work date is if we were working on a project together.  The only issue with this is that rumors and negative speculation come into play. This can be destructive if the corporate leaders cannot harness the rumor mill. 

 

There is a great deal of litigation in our Country right now pertaining to employment law. It’s really a hotbed of activity.  That being said, it is important to note that many people who are being accused and indicted are exclaiming they didn’t have the knowledge of the law.  This law can be broken unintentionally (very easily) by untrained managers and workers.  Yes, as Darkhorse indicated…this is an area where people should tread very lightly.  It may not be logical…but, the court may overrule logic with a half million dollars.

Taxpayer - Maybe you haven't been watching the news lately, but your Conservative State Senate has been ignoring the voices of the taxpayers who put them into office and even tried to lock them out of the State Building. Not to mention drafting bills "in secret". Maybe you should stop blaming everything on liberals and hold your own people accountable. Yikes, fedup248. I am a little embarrassed for you. The "absence" to which the headline refers is the absence of the Clerk of Courts. It is *her* absence. Hence, "Clerk of Courts" should be possessive, i.e. "Clerk of Courts'."

Who in the county is responsible for providing room for stored court documents?  Who was responsible for providing the former home of the Erie County prosecutor's office and the former drug task force to Johnson for off site storage?  Could it be that Johnson lacks the room to do her job effectively? Who has the keys to that off site storage building besides Johnson and her staff?

Just a question for the reporter. Did you read the letter? I don't see where it says "anyone" with questions contact Dr. Baxter's office it says for questions contact the office which means the original recipient of the note not any random reporter or other person. You would think you as a reporter would understand this and the hippa laws. When are we going to get reporters that do their jobs in a professional manner.

As someone who has knoweldge of the Clerks Office, I can say this:

You the tax payers are her boss.  No one else, just the tax payers.  Her opponent (and others) pointed out in the last (2008) election how incompetent she has been over her past 20 plus years at the helm, and how she is RARELY in the office.  They also pointed out many other things such as her lack of putting records on line and the general lack of (not) doing her job; her office is in a "chaotic mess."  Yet after all that evidence, YOU, her boss, elected her to yet another 4-year term.  SHAME ON YOU Erie County tax payers for voting her in for a 6th term after she didn't deserve her other terms.  You have no one to blame for this but yourselves because YOU had a chance to "Change" things and you blew it! !  YOU got what you wanted and what you voted for, so stop whining and complaining! !
