The grandmother who rolled over her four-month-old grandson and smothered the boy while the two were sleeping was indicted for involuntary manslaughter, negligent homicide and child endangering children.
Terri L. Malone, 46, 1500 block Taylor St., turned herself in to the Erie County Jail on Monday. She is free on an $80,000 bond. The grand jury issued a secret indictment on Malone.
"It's a tough, tragic case," Erie County Prosecutor Kevin Baxter said. "The grand jury heard the evidence and returned the indictment, so we'll go from there."
Malone was sleeping in bed with her grandson, Bishop Kane Malone, March 29 in a home in the 200 block of Berlin Road, Huron, when she rolled over the child, according to police reports. Paramedics called to the home could not revive the infant.
If convicted of all three charges, Malone faces up to 20 years in prison and an $80,000 fine.
A police investigation revealed Malone had drugs in her system at the time of the incident. She told police she took oxycodone the day before the incident. She also tested positive for marijuana and Valium, police said. Malone's use of drugs played a key role in the indictment, Baxter said.
