A local judge and attorney was ordered to pay a local couple $13,000 for failing to file their civil lawsuit in a timely manner.

More than five years ago Mark and Victoria Swabley were involved in a car accident. In 2003, they hired Paul G. Lux, 49, as their attorney in their personal injury law suit. He is a Norwalk attorney and part-time judge in the Erie County Court in Milan.

The Swableys alleged Lux was negligent with the case and failed to file their civil suit before the January 2004 deadline. They sued Lux, asking for $50,000 in addition to monetary compensation to cover their attorney fees and court costs.

On Tuesday, a jury in Erie County Common Pleas Court awarded the Norwalk couple $13,000 in damages.

Neither the Swableys or Lux would comment on the case.
