PORT CLINTON

Defense attorneys for Scott A. Speer filed a motion for dismissal during a hearing Monday in Ottawa County Common Pleas Court.

Speer, 34, of Fairlawn, was indicted on murder charges after he allegedly confessed to William Seese he pushed a friend off his boat in August 2002 near Mouse Island. The friend, James Barnett of the Akron area, drowned and washed up on Catawba Island the next day.

Prosecutors originally charged Speer in 2006 with aggravated vehicular homicide and involuntary manslaughter in relation to the incident. Speer's attorneys believe the prosecutor's office violated Speer's rights by waiting too long to file the charges against him and asked Visiting Judge Richard Markus of the Cleveland area to dismiss the case.
