Randleman lawyers want trial moved

Kevin Randleman's defense attorneys say the only way the accused killer can get a fair trial is if his case is moved to another county.

Attorneys Robert Dixon and Jeff Whitacre have asked a judge to grant a change of venue in the accused cop-killer's murder trial.

In a 26-page motion filed last week in Erie County Common Pleas Court, Dixon and Whitacre said the case has received such extensive media coverage there's no way Randleman can receive a fair trial in Erie County.

Randleman is accused of fatally shooting Sandusky police Officer Andrew Dunn on March 19.

Along with the request for a change of venue, attorneys filed a mountain of documents to buttress their points.

Among the materials: four spiral-bound stacks of documented media coverage on the case.

"Prejudice must be presumed and a change of venue is constitutionally mandated," the attorneys' motion said.

Almost 200 stories about Randleman or Dunn have appeared in 20 newspapers in the past year, as well as 51 newscasts on television stations, according to the motion.

The attorneys said more than half those stories have saturated Erie County's 77,000 residents with details of the alleged crime.

They also cited Internet searches that collectively turned up an astounding 10,632,900 results when searching the key words "Kevin Randleman shooting" and "Officer Andrew Dunn."

Additionally, there are two Facebook pages and 27 YouTube videos referencing Dunn or Randleman.

This heap of evidence shows the case has "gone viral," attorneys said.

"To be clear, this is a big case in a small town," the motion stated.

Hey Retiree, I'm still trying to figure out where that probate court rent-a-judge was coming from when he said the complaints filed in Erie County were already resolved five years ago via your attorney filing and immediately dismissing a bogus lawsuit in the jurisdiction of Cuyahoga County --- yet the Erie County probate court (surprise, surprise) doesn't even have a request to change the venue. In fact, there isn't anything at all in the Erie County probate court files about Cuyahoga County so one might have to wonder what that rent-a-judge was even looking at.  A script telling him what he was being paid to say maybe?

@ Retiree: According to this article Randleman's attorneys just can't up and take Randleman's case out of Erie County ---- instead, they have to follow the LAW. (gee, imagine that) They had to file a request for a change of venue with Judge Tygh Tone and give the reason for the request. 

On the other hand, I just found out that YOUR sneaky attorney never filed any request for a change of venue with the Erie County Probate Court prior to filing and dismissing a bogus scam lawsuit in the jurisidiction of Cuyahoga County that had nothing to do with the probate estate of a life-long Erie County resident. Which now makes one tend to wonder where that probate court rent-a-judge was coming from a short time ago when he said the complaints filed in Erie County had already been 'resolved' by that bogus lawsuit YOUR attorney filed and dismissed in Cuyahoga County. No, they weren't. The more than legitimate complaints that were filed in Erie County that the probate court judge Beverly McGookey and the common pleas court of Roger Binette refused to address, included, but were certainly not limited to, complaints against a Lorain County attorney from the law firm of Stumphauzer & O'Toole.

Well said. In view of the vituperative comments that are posted every time the SR publishes an article about this case, it may be better if the trail is held elsewhere. I would hate to see a conviction overturned on appeal because Randleman could not get a fair trial in Sandusky.

The law says that he is charged with a capital offense and can not be offered any plea in exchange for a lighter sentence .

The way I understand it , If Randlemne even plead quilty of the charge he would face the death penelty and it would be left up to a jury of his peers , So I understand

And I do think that a change of venue will only benefit the outcome of this trial. The reason I say that is because it will take ONE, just ONE dishonest juror member to throw the entire verdict out and get the defense a mistrial. Send the trial somewhere where the evidence will speak for itself, not the headlines. Or just offer life in prison and save everyone the hassle. Chances are he will die a natural death before he even gets executed. The Dunn family should be able to move on from this the best way they can.

While I agree with others who say they want to see Randleman 6 feet under, the fact is he isn't. He is still very much alive because our SPD acted in the most professional manner considering the situation. Yes it would have been very easy for any officer to show up and put a bullet in him, but they acted rationally and professional in a situation that I know every single police officer hopes they never have to respond to. With that said, Randleman is alive and in jail, in the USA. As US citizens, we vote every year for laws and bills to pass to be the fairest and most civil country that we can be. While I don't agree with our judicial system, this is however what our country stands for. A fair trial, even for the guilty. It is sickening to know that a year later he is still very much alive and getting visitors. But with the right evidence and a fair jury, justice will be served. Not in a way we all would want, but in a way that our country stands for. I hope he gets the death penalty, yet at the same time, he is still going to be sitting in prison for God knows how long. He may never even be executed before his own natural death.

I feel sorry for the Dunns having to go through this but at least there's one good thing. With all the media attention the courts and the attorneys won't be able to pull off their usual ILLEGAL crap like they do in unknown cases.

Okay, I get all the complaining.  But don't lose sight of the fact that this is the way we Americans run our judicial show.  And I applaud our approach.  Even the worst of the worst are entitled to their day in court.  Hanging an accused from the nearest tree fell out of fashion a long time ago. 

As for the lawyers, they too often get a bad rap.  Yeah, there are sleezy ones, but for the most part lawyers work hard for their clients, even the clients that are assigned to them by the court.  Lawyers are hired to do their job, not to run up the tab.  Representing Kevin Randleman has got to be a nightmare !!  -- especially for a lawyer who is nearing the end of his career (like the one in the photo).         

Whether the trial is moved or not, the defendant and his team of lawyers still have many hoops to jump through before their chances of winning this case run out.  Personally, I'm all in for plea bargaining and moving on to the next case on the docket.  Do the crime, do the time.

   I sure hope I am not called for jury duty and end up on this trial if it is held in Erie County. When I saw the costs of some $300,000 + I thought then I bet this jury is put up in a hotel for the duration of the trial. This trial is not going to be a short one either. It will drag on and on. You look at a May/June time frame and one has anytime things to do at home but at that time of year their is yard work and graduations etc. All that in hanging in the balance while attorney's debate the most stupid things in the case.

   For my part they might as well move it out of the county. I think it makes no difference. He will be convicted and given the death sentence....then what this will drag thru appeals and appeals and some 20 years from now when Randleman and most of those involved are gray haired and some dead of old age they will put this Randleman to death. Then we can say justice was served some 20 years later.

   Truth is this trial could be held in Heaven and Jesus Christ could be the judge and Randleman's attorney's would say Jesus gave him an unfair trail.

    In this case I say lets get real Randleman's attorneys know he is guilty Randleman knows he is guilty just admit it and put Randleman to death and get the whole thing over.

    Randleman has never done much in his life right to date he could change that by pleading guility and just ask for the death sentence and say I am sorry and go quietly away. Save all of us a lot of trouble.

 Sadly witrh our Judicial system, if we only want to go through this trial once, it would be better  if it were moved away... otherwise, after he is convicted here, how many years of appeals will his lawyers  go through saying he didn't get a fair trial because he couldn't find an unpartial jury, then they will complain that the right mixes of genders and races was not adequit to represent him fairly etc.. I think that to allow that to happen would be insulting to the friends and family of Officer Dunn.. so I  say go anywhere and see if anyone would pardon you for  killing a Police Officer in cold blood  without provication...

 

    I would also add that this might hbe a good time to start a new system..  I say we  show him all of the evidence against him now.. before any trial begins, and tell him if he CHOOSES to put us all through a trial, and  having to pay for all of the experts and all of the extra expenses... IF he is in fact found guilty AFTER the trial  his sentence will be to  be put to death within 2 months of the end of the trial..... BUT if he pleads Guilty  after seeing the evidence, and does NOT make us go through the entire  TRIAL process, we will allow him to get life in Prison without any parole ever!!!!!  I get tired of people like him , where it is captured on tape, claiming they didn't do it....OH and if he chooses to declare that he is NOT mentally  capable of knowing that what he did was wrong.. I say good, then it won't be so tragic for him when they start the fatal injection process to end his life.. just tell him it ia a game , heck he claims he doesn't know any better.. so use it toour advantage... in my opinion

Unbelieveable....I don't see how these defense attorneys can sleep at night knowing that they are representing a cop killer. The same thing happened with one of the terrorists from 9/11...he wanted to change venues because he didn't want to have the trial in New York. And they actually granted that P.O.S. it! Our justice system is garbage. Randleman will burn in hell soon enough.

Attorneys for the Cleveland serial murderer Anthony Sowell also asked for a change of venue but the judge sure didn't grant it. It will be interesting to see what Tone does with this.  

That said, since when do attorneys have to request a change of venue? Did the Erie County courts change the laws again or what?  I know an attorney that filed and dismissed a bogus scam lawsuit in the jurisdiction of Cuyahoga County that had nothing to do with the probate estate of a life-long Erie County resident and that snake sure never requested a change of venue.
