(UPDATED W/ VIDEO AT 11 A.M.) An Erie County judge on Tuesday granted prosecutors access to accused killer Kevin Randleman's medical and institutional records.

Prosecutors will have to revise their request, however, if they want to get copies of decades-old records held by defense attorney K. Ronald Bailey, who represented Randleman in a 1990 aggravated murder case.

Randleman, now 50, was acquitted of murder in that case, though the jury convicted him on weapons violations.

He now faces capital murder charges for the March 19 shooting death of Sandusky police Officer Andrew Dunn.

I'm no expert, but I'm guessing the records of the court proceedings from Randleman's orginal murder charge were probably destroyed because they were no longer needed.  He can't be tried for that murder, again.  Records of those court proceedings would be useless for this trial.  If they need records that were used in those court proceedings (police reports, medical records, etc.), they are probably still out there and available.  Julie R., as for cases where someone is convicted, then it is found later that they are innocent, my guess is they probably keep those records longer since there is always the possibility of the conviction being overturned.  I myself have never heard of court records being destroyed.  But if you think about it, it can make sense.

When Randleman was exiting the courtroom, the family should not have been addressing him. Disrespectful and rude. They have been warned before about talking to him during his courtroom appearances. Eventually the judge will have them removed from the courtroom.

I did a little research and found that I was incorrect regarding the Clerk of Courts. I didn't see anything about having the ability to destroy records after a certain amount of time. Unlike Taxpayer, I can admit when I'm wrong and I don't blame people with an opposing political view for everything that I deem wrong with the world today. According to Ohio Revised Code 2303.09: The clerk of the court of common pleas shall file together and carefully preserve in his office all papers delivered to him for that purpose in every action or proceeding. It didn't mention a records retention plan at all, so I take that to mean the records have to be available to the public regardless of how long ago the case was. Even if you can't produce a paper copy, microfilm should have been used. Grant it, the file could have been detroyed unintentionally (fire, flood, etc.). Regardless, Ms. Johnson should clean up the Clerk's office because the file may very well be in perfect condition and just lost in the storage space they have set aside. Maybe they should check with the Appellate Court - if an appeal was filed they'd have a complete copy of the Clerk's file in their records and they probably keep track of their stuff better than Johnson does.

Julie - I was wrong, so feel free to start in on your "Erie County is Corrupt" and "the file was destroyed on purpose at the direction of the Probate Court" comments

Pearl, you need to phrase your question just right to the commissioners or anyone at city hall so they don't have room to squirm around the answer. The commissioners told the truth that the report wasn't back and it isn't back, just some of the results which aren't finished because they have to send more information to finish the report.   It is all in how you ask the question whether you get a straight answer.

The records of a MURDER trial were DESTROYED??  The clerk of court was within her "authority" to DESTROY the trial records of a previous MURDER?  What about ALL the other records being "stored" in disorder and carnage?  Perfectly acceptable?  HOW can a NCIC criminal history be verified when the records are simply destroyed after SEVEN years?  NOW, it is of concern and biting a few of you in the dorsal cavity.  It is very mysterious that old copies of a local newspaper can be organized from a century ago (Sandusky Clarion, Daily Register, Commercial Register days?), but a MURDER trial record?  Just lose them or destroy them right liberals?  It is the typical liberal concept of "out of sight, out of mind" because WHO will ever know?  That is until the SAME person decides to commit the SAME crime of MURDER in their lifetime.  You liberals voted for the clerk of court and continue to make EXCUSES for her performance so you all GET what you deserve.  Exactly like making yourselves "feel good" about a president.  This entire case is beginning to traverse into what I fear.  A liberal jury from a liberal county will be selected.  The chance of, "You are FREE to go" is getting more apparent,...exactly like the 1990 MURDER.  Who is "supporting" Randleman?  Who is covering for him?  Why is it so difficult to get justice?  I can see the liberal PEOPLE have already started to FORGET about the only LE officer shot and killed in the line of duty in the HISTORY of the city.  It is exactly like FORGETTING all about 9/11 and making EXCUSES for those who committed the GREATEST act of MURDER against innocent civilians (NOT military) in the HISTORY of the United States.  But, don't forget about the MILITARY strike at a naval base at Pearl Harbor, right UNION crybabies?  Ooo, those EVIL Japanese!  You UNION freaks and you liberals have been touting RACIST rhetoric for DECADES with the Sandusky Register right along side you in unison.  But, it is not nice to say anything about WHO committed 9/11 and WHY?  Perfectly acceptable for you liberals to be so politically correct?  I am concerned the SAME liberal exasperation will be applied to this SECOND murder trial and the records simply expunged.  Can ANY of you liberals explain that??

by law they cannot put hiim to death. i personal think there should not be a trail because it would be hard for the families and also its very costly, what he needs to do is  just take plea  for life without parole.

Those accused of even the most heinous crimes have every right to due process. Without those rights, the rest of us would have none, either.

At the same time, the general public has every right (and expectation) that the system will act to protect it. Randleman's past history may or may not enter into things prior to a sentencing phase. But if prosecutors made the request, and the judge granted it, it sounds to me like everything is proceding as it should.

My only question involves those people pictured here and labeled as "supporters" of Randleman. Really? REALLY? It seems to me the greater indictment that some people seem to think that the crime with which Randleman is accused might be somehow, under some circumtances, acceptable. If THAT attitude from people who are running around town as free as a bird doesn't disturb you, it SHOULD!

How is that a "conspiracy theory" wondering how records from a murder case could be destroyed? I mean, if records can be legally destroyed after 7 years then how are all these cases being solved 20 and 30 years later that prove people in prison never committed the crimes they were sentenced for? Stands to reason, the records would have to be available, right? For example, they recently proved that some guy from Ohio (who was in prison for over 20 years) was framed by the county prosecutor, a judge and the police. If they didn't have the records from the trial, how would they have proved that?

Julie - I believe the length of time required by Ohio law to keep legal records is 7 years. I know attorneys who keep the records for 10 years just to be safe, but keeping records for over 20 years is just not feesible. Please don't start your conspiracy theories, the clerk's office was well within it's rights to destroy records that far back. I would have hoped the clerk's office had microfilmed the records before destroying them, but I'm sure that would be asking way too much from Ms. Johnson.

Destroyed? I thought all court records were supposed to be kept safe and on file.  Who destroyed the court records? Perhaps the Sandusky Register could find out?
