Checkered past, violent end: Deputy and dead man both in trouble before
Jul 14

FREMONT
Bryan Jones, a man killed after a stand off with sheriff's deputies Sunday night -- had a checkered past, according to court records.
But so did one of the deputies who shot him.
Records show Jones has previously charged with felonious assault after shooting at an occupied house.
Deputy Jose Calvillo, who was one of two deputies who shot and killed Jones on Sunday night, had a last chance agreement with the department for stalking his ex-girlfriend.
Jones' father called sheriff's deputies to his house at 3445 Tiffin Road on Sunday night after his son drunkenly threatened to kill his mother. Jones, 26, was alone in the farm house at the time, sitting on the couch with a shotgun across his lap.
Road patrol deputy Mario Calvillo, 35, and his brother, Jose, 37, responded to the scene with other members of the tactical response team. The deputies attempted to talk to Jones via the house's telephone, but were unsuccessful. They decided to enter the house at about 11:30 p.m.
The Calvillo brothers led a four-man team through the front door, where moments later the brothers fired their weapons at Jones, killing him. According to the sheriff's department, Jones raised his gun at the deputies when they entered.
The Bureau of Criminal Investigation and Identification is performing an investigation into the incident, at the request of the Sandusky County Sheriff's office. The brothers have been placed on paid leave until the investigation is complete.
Jones parents, Kim and Tracy Jones, described their son as a funny, caring, and troubled young man at a prayer service Monday night. He abuse alcohol and drugs and was depressed about being unable to find a job or see his son.
But, they said, he didn't deserve to be killed.
Jones had been on a two-day drinking binge when his father decided to call police. His parents said they wanted to get their son help, and they never believed he would act on his threats.
But Jones does have a history of violence. According to court records, Sandusky County Sheriff's deputies charged Jones with felonious assault after he shot at a Ballville Township home from his car and sped away in 2002. Jones' shot landed just above where a man and his 5-year-old daughter slept, showering them with drywall.
Deputies who responded to the incident found Jones had been drinking. He used a shot gun in the assault.
Jones later pleaded guilty to lesser charges of improperly discharging a fire arm into a house and a fire arms violation. He was sentenced to three years in prison.
He has also been charged domestic violence and most recently with operating a vehicle under the influence, possession of drugs and traffic violations.
Mario Calvillo joined the sheriff's department in 2002. He graduated from Terra Community College's police academy in 2001 after serving four years in the U.S. Marine Corps, where he earned a good conduct medal and a rifle expert badge. Mario Calvillo left the sheriff's office after 14 months on the job to take a position with the Fremont Police. He reapplied to the sheriff's department in 2003 and was rehired as a correction deputy. He later became a road deputy.
Jose Calvillo, in addition to a thick stack of training certificates, has a number of severe reprimands in his personnel file. In 2007, he had a disciplinary hearing with the late Sheriff David Gangwer and Chief Deputy Bruce Hirt for directly defying repeated orders that he stay away from his ex-wife during a messy divorce. Jose Calvillo had a restraining order against him at the time.
According to records in his personnel file, Gangwer and Hirt called the offense "fireable," but gave the deputy, who has been with the department since 1997, a second chance after suspending him for 10 days.
Then, on June 13, 2009, Sheriff Kyle Overmyer suspended Calvillo for 22 days for conduct unbecoming an officer for an off-duty domestic disturbance involving his girlfriend. According to the reprimand, Jose Calvillo had "one last chance" to demonstrate he could improve his conduct.
Then, on Jan. 26, Overmyer and Hirt called Jose Calvillo into another disciplinary hearing for conduct unbecoming an officer.
According to disciplinary records, Jose Calvillo had stalked his then ex-girlfriend, driving to her house multiple times a day, showing up uninvited and following her. He also allegedly tripped her and pushed her in a public place, threw her against her car, pinned her hands behind her back and grabbed her. He showed up at her father's place of employment in uniform and with his weapon, when previously asked to stay away.
Jose Calvillo did not answer questions truthfully when questioned about the incidents, the disciplinary report states.
After the hearing, the deputy sign a "last chance" agreement, in which he agreed to stay out of Fremont bars and improve his conduct. He was suspended for 10 days without pay.
Overmyer said Jose Calvillo is one of the most well-trained deputies on the force, and his disciplinary issues did not reflect a poor work performance.
When BCI is done with its investigation, it will give its findings to the sheriff's department and the prosecutor. Overmyer said it will be up to prosecutor Tom Stierwalt if any additional action is taken at that time.
He said he has talked to the Calvillo brother about the incident, and they feel that they did the right thing by firing at Jones. Still, he said his heart goes out to Jones' grieved family.
"It's an unfortunate thing," Overmyer said. "When we go to these things we want to help, and unfortunately it didn't turn out like that this time."

This is a tragic incident caused by the actions of a troubled young man. What intervention or help did all the new found supporters give this young man in the past, or did they just enable?

Looks like the previous 2 posters are waiting for their payday from the county.
Their comments sure don't bear much semblance with the truth.
Taking the logic the revolution expounds, all police must never break the law at any time or they are no longer fit to wear the uniform.
That's illogical. We all make mistakes. You want all cops to be saints, too?
Perhaps if WE were all saints,we wouldn't need cops at all.
In your world a person can't be in the clergy if they've committed any sins?
You don't eat at restaurants where the cook has ever burned anything?
A financial consultant who has ever lost money should resign in disgrace?
You never speed, fail to fully stop, drive while distracted?
Do you itemize all your internet purchases for state sales tax purposes?
No wonder you're glad you're not a cop. You yourself probably couldn't hold up to the high standards you arbitrarily set for others.
As for Salvatore:
If you are here legally,I'll jump off the I dock if you jump off the pavilion first, compadre.
If not, wait right where you are.
The INS will be with you shortly.

The problem with your analogy, Peninsula, is that WE do NOT hold a position of POWER or AUTHORITY over others.......In the LE occupation, a person MUST uphold and FOLLOW the LAWS!!! The officer obviously has NO respect for the laws, or he would not have a RECORD of BREAKING the LAWS!!
He shows CONTEMPT, if anything...... Lack of RESTRAINT, also comes to mind! I, as a private citizen, do not have to worry about it, BUT, as a LE officer, I would have LOTS to worry about, if I were HIM.........WHICH I AM GLAD I AM NOT!!

Let's just cut to the chase:
You are a policeman holding a gun.
You know that on the other side of the door is a past felon with a gun in his lap.
His own, terrified folks called because of his behavior.
You go in.
The guy twitches holding that gun in his lap as you break through the door.
You mean to tell me that there is one sane soul on this planet that doesn't pull the trigger?
This sounds more like a 'death by police' suicide.
Maybe he figured he could go out in a blaze of glory and get a few dollars out of the government for his survivors to settle any lawsuits.
Maybe he was just cryin' drunk and had enough of the whole situation of his sad life.
Yeah, the officer is a bad actor in his private life. I'd bet there are any number of staffers at the Sandusky Register and likewise a vast number of ourselves who would dread the amount of transparency this officer's private life has taken on.
I'm not known as an apologist for the police, but all in all, this is a righteous kill.

Where were all of these supporters during this young man's life as he abused alcohol, was violent, and in general lead a less than positive lifestyle. How many of these supporters enabled him by their inaction or ignoring the problem. His death was unfortunate but does not change the fact of how he lived his life. On the day he choose to be intoxicated, made threats and raised a gun towards officers while they were attempting to do their difficult job, he choose his own destiny.. It would be fitting if the ACLU (all criminals love us) would join this support. Thank god the officers were able to return to their families after during their job.

The front page heading for this story in the Toledo Blade 7/15, read; "SWAT team member was given last chance. Deputy faces loss of Sandusky Co. job". Evidently the Blade and the SR are both biased papers. From my understanding, (if you listen to the 911 audio tape provided) the Sheriffs' were called earlier in the day. With this young man's "checkered" past, why not do something then? Couldn't he of been arrested for drunken and disorderly, or something like that? Had they helped earlier in the day, this wouldn't of happened! Instead, "despite the disciplinary problems Mr. Calvillo remianed a part of the sheriff's tactical response team (although he was no longer it's leader) and was one of four members who (volunteered),came in on overtime Sunday night when it was determined the team was needed to remove Bryan Jones from the house". His family called for help, twice! There was no one in the house w/Bryan! I'm sure his family would've preferred it be alive, not shot to death! Most of you people want to re-crucify this already-dead young man for the mistakes he made. At least he served his time, paid his debt to society. On the other hand, Calvillo was given chance after chance after chance., even after signing a "last chance agreement". "He was warned "to stay out of Fremond bars, except as it relates to his children's activities...refrain from any on or off-duty conduct which is un-becoming to an officer, and treat all members of the public in a courteous and professional manner". No charges were ever filed against him in December (imagine that) when he became physical w/his ex girlfriend, but he was issued a "no contact order" to stay away from his ex girlfriend and her CHILDREN, and was to refrain from any harrassing behaviour in any way towards them". That was issued by Sandusky County Common Pleas Judge John Dewey. He certainly had a problem answering questions, truthfully! Could he have a drinking problem, just like this young man they killed? The Sandusky County SWAT team may want to do a bit of studying up on alcoholism, especially binge drinking, as well mental health issues! This young man was on a two day binge, I guaranfreakintee he was in black-out stage and had no clue what hit him, let alone saw it coming! His Father stated when interviewed by Toledo news that they "obliterated him!" This case has been turned over by the prosecutor to the Ohio Attorney Generals special prosecuting unit, and at some point in time will be brought infront of the Grand Jury. Don't get me wrong, I'm well aware an officer's first duty is to themselves, to make it home safely, and I really do appreciate their daily sacrafice, but don't kid yourselves in thinking there aren't officers out there who have NO PROBLEM w/abusing the power they hold! It happens everday, somewhere! Even in Fremont! The horrible part, it's been looked past by Superiors and fellow officers, and excuses are being made by union lawyers! There will be a rally Sunday at 2 p.m., at the corner of State and Front Streets to protest the shooting. This rally has the backing of the Toledo Foreclosure Defense League and the New Order Human Rights Organization (not familiar w/them). Would be nice to see Toledo's NAACP Chapter, as well Ohio's ACLU involved as well!07:12 AM

It sounds to me like Jose Calvillo was not an asset to a law enforcement agency but a liability. If Bryan was sleeping then why spook him by charging in? I was reading another newspaper that the Calvillo brothers were the first two to enter where Bryan was sleeping. What did the other two deputies see? If Jose Calvillo did not answer questions truthfully when questioned about the incidents involving his ex-wife and girlfriend then how can he answer truthfully about the shooting? What did the other two deputies see? How would the girlfriend and ex-wife describe Jose? Under the influence or mentally ill, the police need to protect people from themselves at times such as suicide attempts. There was no hostage. There was no need for the cops to act as executioners. They could have waited it out. No hostage, no need to go storming in. There have been other people like Bryan that are alive today because the cops waited.

This a a tragic event where a young man lost his life, but as to be expected from this poor excuse of a newspaper they make the story about one of numerous officers involved. The young man was intoxicated, had made threats, had a history of violence and raised his gun towards the officers. Any hesitation by the officers could have resulted in the death of an officer only trying to do his job. Now the parents attempt to place blame on others, my question, did they ever enable this young man, bail him out of trouble, make excuses for him, if so they are part of the problem. Thank god all of the officers went home to their families.

I am also pretty sure that I never justified this guy's behavior. My contention is that you cannot assume to blame the parents. If you want to get biblical ~ why did the prodigal son do the wrong thing? Obviously his father must have been doing something right, the other boy was fine. We live in an imperfect world and I do think that most of us are really just trying to do the best we can. Blasting his parents without ALL the facts is judgemental and wrong.

This must have been a real horrendous experience for this guy's parents------something they will have to live with now and have nightmares over for the rest of their lives. Some of you commenters blaming the parents for their son's mental problems is ridiculous. Blaming the parents for calling the police is also ridiculous. I'm sure had the parents known what the outcome was going to be they never would have called the police to begin with.
As for the deputy that shot the young man----I don't understand why he was given so many chances to "improve his conduct." Somebody with that bad of a temper should not even be allowed to carry a gun much less be a police officer. His past conduct shows he certainly must have mental problems himself.

Kimo,
There is no text book answer to how long a law enforcement agency should wait before entering a residence. One could argue they waited too long to enter the home. The longer the offender is in the home.....the more opportunity the offender has to build barracade(s), get more guns/ammo, move to a better point of view to fight or hide. Once again, this story has very little to do with law enforcement personnel and/or operations and more to do with family dynamics, family communication and let me not forget about a convicted felon with a past history of violence using firearms under the influence of alcohol/drugs, depressed, made threats to kill family members and holding a loaded shotgun.

my2says that I and the rest of American needs to educate ourselves on mental illness, , you have to be kidding! If you are saying this to make me feel goooy inside then fine, but if your posting this rubbish in a effort to dismiss this criminals behavior hit the road, you have nothing that will convince me that this guy had ANY reason to do what he did this last week or his entire live. If he was so bad then it’s once again his parents fault for not having him committed, which I consider a crime for allowing him to be a detriment and endangerment to society. If they owned a dog that attacked people they would be charged but not when they raise a son that shoots people’s homes and makes threats and THEN allows him into their home with a gun? They are accessories to the fact.
Long time posters here know I don't give cops ANY slack; I hold them to a VERY high accountability. But to say this cop was somehow wreckless is absurd!
Your post about 'walking in someone else’s shoes' just shows me you don't have a clue to reality. How about the shoes of those people sleeping in their homes and having a bullet go through their home, endangering the lives of their children!! You secular humanists ALWAYS make excuses for anti social behavior and excuse it with your pretentious theories that degrade the moral fiber or social justice which reduces the safety of society as a whole. There is ALWAYS someone else who has it worse than others but they don't go around threatening to murder people or shooting up people’s homes. NOTE that I don’t glory in the fact that this guy is dead, but I wont sit back and say ‘the poor guy, what went wrong?” IT’S OBVIOUS WHAT WENT WRONG, look at this guys total life of crime and thumbed nose at others safety, rights and well being! He only cared about one person, HIMSELF. IF your claim of mental illness was even remotely a possibility then I would say that Bryan wasn't the only one who had mental illness, but I don't believe that either, I say it was just plain old lack of educated parenting and constant excuses for ones behavior, and the end result is terrible ending. I also know the family hurts and I do feel sorry for them, but lets not candy coat this story so others will do the same mistake and have their kids end up the same way. Its called TOUGH LOVE, not excuses as you are proposing. Your position is just like the parents, ‘he had problems BUT…” Where did those excuses get Bryan? And you think WE are the ones who need to be educated? I think before you say that WE need to become educated and walk in others shoes that YOU LOOK IN THE MIROR, or better yet, the results of the same crappola Bryan was feed, that he was a good boy, HE WAS NOT A GOOD BOY and when someone lives as he did the end result usually is the ultimate price. You can’t mount facts, you play with fire you get burned, you point a gun at a cop your dead. Personally, I feel more sadness for the cop and his family, they did nothing wrong and now have to deal with this all because Bryan decided to thumb his nose at society. The wages of sin is death, and a little piece of this cop and his family died too.

I love how so many come on here and bash the law enforcement officers who were doing their job. This guy has a history of violent crimes, had been drinking for two days, and threatened to kill another human being. Then to top it all off, had a loaded shotgun through out the whole incident. He had plenty of opportunity to talk to police and give himself up, but he didn't. I know these officers, and while one has a checkered past, he did what he felt had to be done. I am sorry that someone had to lose their life, but what would all you say if he had killed someone else, or himself, or an officer? Would you still have this same point of view?
I agree with Bailey, if the parents want someone to blame, they should start with themselves. I was raised not to act out in violence, not get drunk and act a fool, not shoot at other people's houses, and not beat my girlfriends. I was also taught at a young age to obey an officer. Why did he have access to weapons or alcohol in the first place? These are what got him into trouble in the first place. Just My opinion.

I don't think anyone called him "mental." FYI, I'm not libral but I am also not going to "assume" his parents did a terrible job raising him. You nor I have any idea what events led up to this point in his life. All I am saying is it sounds like there was some severe depression. I pointed out that the same person could be "Fun loving" and extremely depressed if they suffered from something such as bipolar disorder. Incidentally, just because you are depressed it does not mean that you get off the hook for committing crimes. If he had come out of that house he probably would have been arrested again. Baily, clearly you, like the rest of America, needs to educate themselves about ALL forms of mental illness, including depression. Until you walk a mile in someone else's shoes...

This is a ridiculous report, the cops came to the home, the guy threatened his parents, he was drunk for two days, he commited crimes with guns and gets shot, so what does this paper do? They PERSONALLY ATTACK THE COP with him being upset about a break up! Did the COP shoot at home? NO, Did the COP threaten his ex with a gun? NO, did the cop think his life was in danger when the guy raised the gun at him? Y E S !!!! so what does the S.R and other do? They make excuses! He also allegedly TRIPPED her and PUSHED her in a public place, THREW her against her car, pinned her hands behind her back and grabbed her? WHY NO DOMESTIC VIOLENCE OR ASSAULT CHARGES? How many last chances did this hot headed cop get? And you people support cops like this? How many LAST CHANCES does this loose cannon hot head get? Why is this hot head carrying a gun being allowed to bust into a house to kill a man? Bryan might still be alive to get needed help if this rogue hot head loose cannon cop had not barged into that house. Of couse the two brothers will make up a story to cover their butts. If you and I did what Jose did stalking his ex-wife, assaulting his girlfriend and defying restraining orders, you can bet that you and I would have our guns confiscated and that we would be sitting in jail.

Bailey has me fuming right now! Im glad you are perfect and that mentall illness has not touched you or your family. You have NO CLUE what mental illness is or what it's about. I can not believe you have the nerve to balme an illnes on how a parent raises a child. There are lawyers, judges, doctors, police, teachers and the list goes on, who have mentally ill children. Apparantly they are awful parents too!!! To say that a police officers personal life has no bearing on his job is pure stupidity. if he is breaking the law, how can you possibly think that doesnt affect his judgement when it comes to upholding the law? I am not disputing the fact that If the man did aim at the police, then the officers obviously had to make a decision. Who better to back you up on everything than your brother.

I don't understand why some of you commenters are crucitying the Register for reporting the past conduct of one of the officers that shot this young man.

Is it unusual for brothers to work in the same department?
To be on the same shift?
To both respond to the same call?
If anyone were going to lie for me, I hope it would be my brother.
Is nepotism the only qualification to work in government in this part of the state? There was a time when, if you had a close relative employed by a government entity, then you would not be hired, to avoid the appearance of nepotism. Those days are gone.
Will some of the same commentators who decry nepotism in the school districts and municipal governments now defend it in law enforcement?

Baily, I often agree with your posts, but please don't be so closed-minded here. It is not always the fault of parenting that creates these problems. Consider someone who suffers from bipolar disorder or some other mental affliction. If this is the case, then someone could have a great sense of humor, be fun loving AND have a quick and unreasonable temper with bouts of severe depression and dependency on drugs or alcohol. This situation is sad all the way around. One thing that has come a long way but is still severly lacking is understanding and treating mental health issues. To this young man's parents, I am so sorry that it had to end this way. We always hold out hope that some drastic change will happen. We want so badly for someone to have the answer. To their critics: what else could they have done? Tell me what parent finds it easy to call the police on their own child. Prayers to all in this horrible time.

The officer's personal life has nothing to do with this story at all! I'm sure he wasn't thinking "oh I stalk my ex-girlfriend (supposedly) and so I'm going to kill this guy just for the fun of it."...that doesn't make a bit of sense at all! Why put something in here just to make the officer seem like the "bad guy" when he did nothing wrong? Law enforment or not, you point a gun at me and you are going to get one right back at you!

Register.. Note to you.. why keep this "Murder" theme going????
Deputy Jose Calvillo, who was one of two deputies who shot and killed Jones on Sunday night, had a last chance agreement with the department for stalking his ex-girlfriend
Can someone tell me how this is relevant at all to him doing his job? Was he dating this guy he shot?? If not, then I do not see how it is relevant at all at the moment.
This is one main reason that todays news outlets cannot be trusted. They dig up all the dirt on someone and burry them with it in the public eye, even if it does not pertain to the situation in any way shape or form. Many people now look upon this incident as the cops were in the wrong. there are a lot of people out there that live to hate cops, and thoes are the ones that get just extra stired up by stories that newspapers or anyone for that matter take WAAAYYYYY out of context like the SR has with this story.
And again let me say, I do not know they full story, only what I've read. This is just my opinion. We do not know all the facts and only 3 people know for 100% what happened inside. None of us online here know. I do continue to not find anything in the situation where we need to start blaming cops at all in this situation.

Yet another example of the yellow journalism of the Registerag. They wonder why their circulation and ad dollars are down. This should be an article of a tragic incident where one young man lost lost his life and the officers will live with this forever. Instead the Registerag brings up a totally unrelated article on the personal life of one officer, how does that relate to this subject? Bottom line I guess their is a reason they work for the Registerag instead of a real media outlet, no Pulitzer Prize winners here.
