Gay men: We were jailed in Ohio without our pants

Two gay men who say they were punched and pinned to the ground by an off-duty police officer before being called offensive names and jailed without their trousers have sued the city and its police over what they call anti-gay bias.

Steven Ondo and Jonathan Simcox said the off-duty officer, who was a neighbor, complained about a noisy argument on the street and attacked them last April and had them arrested. A week later, they said, they were arrested by SWAT officers and were punched again at their home while lounging in T-shirts and underpants. They said they were denied a chance to get their pants and weren't provided with any in jail for a day.

The men were charged with assaulting the officer but were acquitted Oct. 20 in a non-jury trial.

Ondo, 22, and Simcox, 25, filed the U.S. District Court lawsuit against the city and its police last month and asked for unspecified damages. They said their goal was to deter biased treatment by police.

During the second arrest, the lawsuit says, the officers repeatedly referred to Ondo and Simcox as "faggots" and said "faggots don't get to wear pants to jail" when they were transported to the city lockup. Simcox's brother was at the house and asked if he could get the pants for them, but police refused, although he was allowed to get their shoes, the lawsuit says.

Police usually allow cooperative arrested people to retrieve their clothing.

A top city official said Friday the city wouldn't discuss details of the litigation.

"The city of Cleveland is aware that the lawsuit has been filed and will appropriately address this legal matter in court," interim Law Director Barbara Langhenry said in an email.

Ondo and Simcox could not be reached Friday. No phone was listed for Ondo in court records, and a phone number for Simcox provided by his attorney wasn't accepting calls.

Attorney Dan Chaplin, who represented Ondo in the criminal case, said each man weighs about 120 to 130 pounds and they were tossed around like rag dolls by their 225-pound neighbor.

About a week later, he said, a SWAT team calling them "fags" and "queer" arrested them at their home at about 5:30 a.m. on a warrant accusing them of assaulting a police officer. The team then put them in a police van and drove around for a couple of hours making other arrests, he said.

"They were humiliated and embarrassed. They were shackled to strangers while they were in their underwear and they couldn't leave," Chaplin said. "And the other guys that were arrested were allowed to get clothes on."

At the jail, he said, police mocked them, telling them "fags don't deserve to wear pants" and asked them questions about their sex lives.

"It was just real old-fashioned gay bashing by the Cleveland police department," he said.

Cleveland police and the city's Office of Professional Standards said no complaint had been filed in the case, mayoral spokeswoman Andrea Taylor said.

If I'm wrong, where are all of the reports in the paper about this? There really aren't any. You don't hear about a gay person holding their significant other on the bed at gunpoint threatening to kill them so they son has to stab the guy 3 times - do you? You want a messed up kid - I think that would be much more harm than living with a couple of gay guys or girls that actually get along and work in the community and pay taxes.

Read the story!  If the first part is correct, two smaller frame guys are easily handled by an off-duty police officer in front of "their" home.  Now they know where they live but when do they come to arrest them????  5:30 A.M.???   Yes, however you look at them, you have two residents "NEIGHBORS" to some, who have been mistreated.  I would certainly defend any of my neighbors if this happened to them, man, woman, white, black, gay, straight, don't matter.  What does matter? Could be you next!

That was done in 2002, since then there has been other research that has suggested the same outcome.  

Also, anal sex is not just a "gay" thing, many straight people practice anal sex in their sex lives as well.

Homosexuality isn't a "perversion against nature." If it were, we wouldn't see it in the animal kingdom. Since we do... It is, strictly speaking, abormal. I'm not saying it's bad or good, but it isn't normal insofar as numbers are concerned. But then, being albino isn't normal, either. Nor is being tall enough to be a professional basketball player. Gentics do what genetics do, and it's pretty unfair to judge somebody for being what they are.

As for the overall issue of civil rights, I don't think homosexuals should have special rights. But then I don't think any group should have special rights. I think they should have equal rights (and when I say "equal rights," that does not mean a guaranteed equal outcome, so let's not start talking field-leveling, liberals).

But specifically concerning gay marriage, you might want to be careful what you wish for... Some churches recognize gay marriage (though most don't). If laws are passed that ban gay marriage, you're effectively telling churches what sacraments they're permitted to administer, and which they're prohibited from performing. That means the same type of justification and force could be used to command churches comply with one thing or another. I'm almost positive that if you stop and think for a moment, that's so not a precedent you want to set. Look at the demands being made of the Catholic Church by the Obama administration this past week, and you'll see a comparable notion that's gone over the edge.

My only problem with gay men is that some of them really put me to shame as a woman.  I am a pure proponent of equal rights and believe gays should be allowed to marry and be as miserable as we hetero's (at times).

Anyone here remember the 1998 brutal beating and  murder of Matthew Shepard in Wyoming?  There was a Gallop poll done way back In 1999, and 75% of Americans believed  that Gays should be covered by Hate Crime Laws,   Fast forward 12 yrs.,  and there are even more politicians, pundits, preachers and their churches, and now we can add some  LE to the list that do nothing more than ad fuel to the flame of hate and the violence that follows.    The FBI has gathered stats that prove it and Civil Rights orgs. have uncovered that Gays/Lesbians are "2x's more  likely to be attacked in a violent hate crime as Jews or blacks, more than 4x's as likely as Muslims, and 14x's as likely as Latinos". 

A past example:   At a local Baptist Church the Sunday following 9/ll (of which churches  had the highest rate nationally of attendance) the Minister of the Church I use to attend  literally blamed Gays throughout our country for the attack!  His words, not mine.  

Fairly present example of a quote by a Hater:

"Where can I get that Wyoming printed instruction manual?"  Made on 7/23/20ll by Tim Ravndal, the Montana Big Sky Tea Party Association President, . in a Facebook exchange.  He endorses the hanging of gays.   He was ejected from the group.  My guess is he's still around, in the background and still helping pander a more moderate, subversive form of hate propoganda towards the Gay Community throughout this country.

Thinkagain , Always seems to gay bash whenever something about homosexuals comes up . Perhaps he is angry at himself with pent up latent homosexuality ? These men involved in this sexual assault ( the neighbor and the swat team ) should be dealt with harshly if found guilty . Yes , I called it a sexual assault because if this had been done to a woman all hell would have broke loose on these officers.
