Repeal 'stand your ground'

The “stand your ground” laws in Florida — the same template used for almost identical laws in Ohio and other states — resulted in the not guilty verdicts that many see as unjust in the trial of George Zimmerman. 

At its most basic level, Zimmerman armed himself and ignored police when he killed Trayvon Martin, who was walking home unarmed after buying a bag of Skittles and a soft drink at a neighborhood store. That’s what happened. Florida law — and Ohio law — make it legal to kill, but not right. 

These laws provide vague and codified terms to the intensely complicated act of killing and render almost any outcome in such cases — and potentially in less similar cases — the same as the verdicts that found Zimmerman not guilty on both manslaughter and murder charges July 13.

Ohio and 24 other states have “stand your ground” laws modeled after the same legislation Florida lawmakers used to enact its state law that provides a path to justifiable homicide with the weakest of circumstances. Trayvon was a teenager, who was walking home to his father’s house when he was killed. 

At its most intense center, these laws are derived from good, if fearful, intention, wrapped into the always difficult American system of courtroom justice. The national GOP successfully pushed the legislation inside state capitals across the country, but the outcome is not what these lawmakers likely intended. 

“Stand your ground” laws are emotionally opportunistic, destructive, and create situations to kill and glory in the killing. 

The president of the Sandusky chapter of the NAACP offered readers his reaction after Zimmerman verdicts were announced. 

“Try to imagine the situation reversed, if a black man shot a white teenager on his way home in his neighborhood,” Jim Jackson said. “There would be outrage among everyone. What it comes down to is the question: ‘Is racism dead in America?’ Obviously it’s not.”  

We’re hard-pressed to see any plausible argument to refute what Jackson, and others, have said. We hope the Sandusky branch of NAACP, other Ohio chapters, the national NAACP, the ACLU, residents and legislators unite for repeal, to remove these laws.

Really, I'm shocked that the majority of the Register Editorial board didn't do any homework at all. The "stand your ground" wasn't even used by the defense and had no bearing in the case. It didn't result in the verdict in any way. This "viewpoint" is the most slanted and incorrect I have seen yet from the Register, and that's saying a lot. Shame.

It did have a bearing on the case. Did you listen to the juror who spoke out? She clearly stated SYG had an impact in their decision. DO YOUR HOMEWORK!

The Register again gets it wrong. Stand your ground had nothing to do with the Zimmerman case and was not used in the case. Basically stand your ground means you have he presumption your innocence if you have to defend your life. Is that not the way our justice system is supposed to work. You are innocent until proven guilty. The Register would have you guilty until proven innocent and spend your life savings to prove yourself innocent. So tell us Mr Westerhold, how Stand Your Ground was used in the TM, Zim case? Stop with the unarmed child act. TM was admitted to using "lean" Robatussin & Ice Tea mix, pot in his system, was currently on his third time on school suspension, was caught with burglary tools and jewery previously and was a known fighter. After have 4 minutes to run or walk 200 yrds to his dad's appartment all evidence points to him confronting Zimmerman, and the star witness by the prosecution that wa stalking on the phone with him believes he struck the first punch which is a crime. Stop with the unarmed child smoke screen. He was armed with fists and concrete. The only eye witness seen TM pounding Zim on the ground and all injuries to Zim support that.

The "Register Rag" does it again! To all you bleeding heart morons (no pun intended) that are screaming justice for the thug that was killed I ask you to PLEASE name 1 of the other 1500 black teens that have been killed since the February 2012 shooting of Martin....Thank You...nuff said. The washed up media has made the issues in this case, NOT the actual facts. I believe this COULD have ended differently, however I was not there, but can tell you as a CCW permit holder, I will draw my weapon if I feel threatened and if I draw, I will shoot and I will shoot to STOP the threat using 1 shot or empty the gun, whatever I feel it takes at that moment. One more point...I will do this no matter what "color" the threat is.

The problem is not with you protecting yourself., the problem is if the fear you feel is real or the fact that you have a gun makes you brave and heroic. Anyone can say they were "scared". Your CCW permit does not give you the right to do anything but carry a gun. Don't be a coward after allowing fear to dictate your actions. You have a duty to retreat if possible. Remember that!

You are correct! A CCW doesn't allow you to fire a gun. The self-defense laws allow you to fire the gun that the CCW allows you to carry. Your being a coward has nothing to do with either the gun or the CCW. I thought the other day you were saying you weren't a wuss and didn't have to walk away when confronted or followed? Have you changed your mind and now say you are a wuss and have a duty to retreat? You really can't have it both ways.

The self defense law says you have a duty to retreat if possible. The gun gives you a false sense of security and allows you to act cowardly while thinking you are a big bad brave guy. Martin had no duty to retreat as he was minding his own business and not breaking any laws. Pay attention please, it's not that hard!

Where in the self defense law does it say when you are on your back being straddled and beaten, you are supposed to retreat? how is it possible to retreat when you are being straddled and beaten? Pay attention please, it's not that hard!

Trayvon had one 1/4" x 1/8" mark on his hand. Not much for someone supposedly beating someone. Of course those of you who have never been in a fight wouldn't know.

The only injuries on Zimmerman were his broken nose and on the back of his head. If as you suggest there was no beating what was the eyewitness of one straddling the other and doing ground and pound, and all the screaming recorded by 911 show? That no beating happened? Really?

As far as fighting goes is this another example of you reading minds again? Or are you looking in your crystal ball?

I am not surprised you don't explain Zimmermans broken nose, cuts on his head, witness's testimony about Martin on top going MMA ground and pound. Just doesn't fit in your narrative when you add the evidence testified to in court. Must really suck for you.

Ohio doesn't have a stand your ground law, it has a Castle Doctrine, with a Vehicle extension. the Register wouldn't tell you that though.
