Questions for Baxter

Dear Kevin:

Thank you for agreeing to review and answer our questions about inaccuracies in the Murman statements attributed to you. We talked with a number of participants who were not interviewed by the Murman investigators, and, after reviewing your statement, the Murman report, the Nuesse response, the Darden report and other documentation, we compiled these questions for you.

Baxter statement

• “The U.S. Attorney, unaware of the chief’s failure to coordinate with local officials, cooperated to a point by opening investigations.” Were these DEA, or DEA-related cases? Please detail local cases on file with U.S. attorney since Aug. 1, 2006, and provide case and report numbers and any available documentation.

• Did the U.S. Marshal’s office invite all local law enforcement agencies to participate in Operation Falcon? Is this fugitive roundup a “wasteful and disruptive stunt,” as described in the Murman report? Which agencies chose to participate? Please explain.

• In your statement you say McClung and Nuesse “both wanted to disband the drug task force.” Did other police chiefs express similar thoughts or support for this position, or come to support this position? Please explain.

• Are there corrections to the statement timeline on task force tax initiative, election, support for drug task force, closed-door meetings, when officers were pulled from task force, etc.? Please explain.

• Murman statement indicates you complained that Nuesse “started taking many cases to the U.S. attorney.” Were these DEA-related cases? Please explain and provide details and reports of each case.

• Specifically, about the McGovern “child abuse” case: Were errors discovered in how the arrest warrant was issued, coded or otherwise created or errors with the warrant radius status? Where did these errors, if any, originate? The child’s mother reported the rapes in August. McGovern, a truck driver from California, eluded Huron police when they tried to question him. Federal marshals arrested McGovern in December after requesting the warrant radius be corrected. What, if anything, does this case have to do with the Nuesse probe? Please address concerns about timeline, problems with the warrant, and the sheriff office’s failure to attempt to serve it.

• Please provide information, details and reports of second rape suspect involving a (about) 13-year-old victim where charges were dropped in 2007 when the suspect was located about two years after warrant issued.

• In Murman statement you recall both the (1) U.S. attorney meeting and the (2) meeting with school officials as “educations” for Chief Nuesse. This point, others in your statement, and your general descriptions of these two meetings differ from recollections of the other meeting participants. Please explain.

• In Murman statement you said Nuesse “should have” brought any gang concerns to your attention. Is that required by statute? Please explain. Did she attempt to do this without success or feedback from your office? Was she referred to Barlyski and did Barlyski return her calls? Please explain.

• You describe Barylski as the local “gang expert.” Please provide documents and information on credentials related to her proficiency. Please also provide approximate number of cases, with case numbers, during the past five years that included gang specification charges.

• You state you had not “heard back” from Nuesse about the drug forfeiture fund. Didn’t the police chiefs, through the Firelands chiefs association, resolve this rather quickly with a framework for distribution prior to Nuesse’s suspension? Was it finalized shortly thereafter? Current status of drug forfeiture funds? Was it Chief Nuesse who pushed for distribution of these funds initially? Please explain.

• “Baxter was of the opinion Chief Nuesse, rarely, if ever got input from other city or county government officials before she acted and as a result she has made numerous questionable decisions.” Please provide detailed list of questionable Nuesse decisions, and any impact or potential impact these decisions had. Nuesse, and others, have said the department accomplished several outreach goals in the past two years, including improved relations with schools and school officials, local religious leaders and church members, other police chiefs, and state and federal law enforcement agencies in addition to minority groups. Have there been improvements along these lines, and, if so, how does that square with your statement?

I really feel for Matt Zahel. If its not football its basketball. Hopefully, his brother Shawn can carry this game into the rest of the season. With the play of Kromer and the improve play from his younger brother, Matt might leave Margaretta with at least a sectional title and hopefully a district title too.

I really like your story about the Buckeyes/ For them to go far in the end will depend on the play of Lewis, Butler and Harris. They have to really become more involved with the flow of the offense.

The Assistant Coach is Matt Smith not John Smith. I hope that is a typo of the paper and a miquotation of the coach. Regardless it needed to be noted.

Congratulations Perkins Swimmers! The tradition continues. Perkins Swimming is one of the top swimming programs in the state. Three of our swimmers are top seeded. Good Luck to seniors Monica, Alex, and freshman Katie Quinn making top seeds is a huge accomplshment. Also congratulatlions to Jess Cole we are so proud of you.

I think that perkins is a really good team. I mean 19 WINS in a row, that's hard and that takes teamwork. It's all about blood, sweat and what we had last night, tears.

I think the Pirates gave everything they had, but it wasn't enough. Hallock was off all night and we didn't get any production from Josh Lowe or Jarod Patton. Give Port Clinton credit, but I think Perkins will kind of be in hangover mood against Oak Harbor and if they beat them easily, they are going to be toast for the competition ahead.

Perkins is a good team and i think they have had a very good season but you know i guess they just didn't want it enough. They should have gotten it having 19 wins in a row, thats takes alot of teamwork. But they just didn't push forth to it and this stuff happens

Nice game by the Pirates... PC had a great game and Celliers is a decent player. Besides Justin Caudill, Perkins needs to find another inside threat... because their height may come back to haunt them. I wouldn't be at all surprised if they put a physical guard down-low and ran 4-guards for the tournament.

port clinton came out on seniors night and destroyed perkins in the first half. perkins came back but my main man jason cellier knocked down two threes . perkins didnt deserve to go undefeated so i am glad that my team won.

Perkins loses _1_ game and they're overated, yeah right they are the best in the sbc. Port Clinton only #2 because the sbc sucks and has only 1 team worth watching. Cellier has one game and now he's the man. There's a positive to the perkins loss too. If Port clinton even makes it to the second round, Perkins will annihilate them! Even worse than the first time they destroyed port clinton.(80-60). The refs sucked, port clintons coach and players talked crap the whole game and didnt get a technical. What do you mean Perkins didn't deserve to go undefeated, they're the only great team in the sbc. Lets see who makes it farthest in playoffs.(Perkins).

if perkins shot like port c did they would of killed port c by 50. Port c just got luckey they actually shot good and perkins was off. perkins will kill port clinton in playoffs if pc gets that far.

Cox ur the worst quarterback in the area. I know football and go to all the games to watch both of my daughters cheer for the Pirates. I know Perkins and Port Clinton simply isn't as good. Luckiness happens all the time. I think you are very immature to post on here, especially considering you didn't come out for basketball.

Perkins boys don't let the (talk) get into your heads. You guys are a fantastic group of talented young men and you should be very proud of what you acomplished this year!!!

Told you Perkins WOULD NOT BE perfect and if they lost to P.C. (GO PC), then how do you think they would fare against DAYTON DUNBAR?????? DUH!!!!!!! We all know that answer!!!
Perkins, get used to it.....the SEASON is ALMOST OVER!!!!!!!!!!!!! A good record, yes & yes a GOOD JOB, but going all the way to STATE? Don't think so!!

GBC fan... I would put any amount of money on it that perkins would win the greater buckeye conference... so dont act u play tip-top competition. Lima Senior is nowhere near there calibur of the last five years. Mansfield doesnt compare, and Sandusky almost got beat by Port Clinton themselves. I want to see Perkins play Findlay because I don't think FINDLAY could match up with them. Perkins rocked PC by 20 at their home floor. Lets sit back, relax, and wait till friday if PC makes it that far.
