Fundamental fairness? Forget about it

NOTE: Retired Lorain County Common Pleas Court Judge Joseph Cirigliano did not sentence a woman hell-bent on making Erie County Prosecutor Kevin Baxter uncomfortable to eight years in prison. Judge Richard Markus sentenced Elsebeth Baumgartner. A previous verson of this blog contained incorrect information.

You better believe the "fix" to make sure fired Sandusky police Chief Kim Nuesse stays fired is already in place. Law director Don Icsman recommended the city civil service commission appoint retired Lorain County Common Pleas Judge Joseph E. Cirigliano as its hearing officer for Nuesse's appeal of her termination, and that's what the commission did on Monday.

What's wrong with that, you might ask. Well, first off, Icsman is so deeply imbedded in this controversy he has no business recommending anyone do anything on this matter. Icsman effectively approved the $22,000 Murman investigation without any input from city commission, which is required to review and give prior approval for such expenditures. City commissioners should be asking if the city charter was violated when Icsman approved the biased and bogus Murman probe, and if it was violated why their law director ignored city law on this huge waste of taxpayer money. Icsman should be held accountable for his decisions, and he should refrain from any further input on this sad, sad, sad affair.

Why haven't those questions been asked? Why is Nuesse the only person being held accountable? Why, indeed?

And Cirigliano? He has long-standing ties to Erie County Prosecutor Kevin Baxter, who was a witness in the Murman integrity probe and provided questionable testimony against Nuesse to the Murman investigators. Baxter later "corrected" the tainted Murman report after the Register raised questions about the accuracy of his statement.

What gave Baxter the right to alter a public document? Is he above the law? Why is Nuesse the only person being held accountable? Why, indeed?

Cirigliano ruled in favor of Baxter in a court dispute with his brother over the estate of their parents. Cirigliano has no business serving as the civil service commission's hearing officer in Nuesse's appeal. He should step aside and he should do so immediately. Surely, there is someone better positioned to provide the "fundamental fairness" this situation demands. That person is not Judge Cirigliano.

To some of you people with your jokes about the widespread corruption in the Ohio Courts and right here in Erie County with these inept judges, prosecutors, attorneys, etc. Have any of you people ever sent a loved one off to war? If so, wouldn't it make you sick to your very soul that your son or daughter fought and died for THIS?

Don't paint all commissoners with the same brush. Only ONE has stood up to the powers that be. Not once but several times. Do your homework and support publicly that ONE who has nothing to lose.

Both a cousin and nephew have served in the war in Irag, as well family members in Desert Storm, Vietnam, Korea and WWII. Wasn't too young to comprehend the horror of Vietnam, or the fear that my two older brothers would end up drafted! Most that make light are those that have NEVER experienced the CONCERNS, PURE DREAD that comes along with sending a LOVED ONE off to WAR! Gotta walk a mile, sometimes more in someone elses' shoes to COMPREHEND! The majority of politicians, members of Congress, the Senate, all the way down to LOCAL GOVERNMENT have NO MILITARY EXPERIENCE, as well their children! The ELITE don't/won't serve in that manner! It's been proven! If there is one thing in life I am grateful for, it's those that fought, died, or came home broken so that I may EXPERIENCE THE FREEDOMS these men and women fought for! Such as the Freedom of the PRESS and the ability to comment on sites such as this! Freedoms I RESPECT! What our service men & women do is pure UNSELFISHNESS....to be willing to lay your life down for your brother or sister, as well a stranger! They do it for WE THE PEOPLE, and those in other countries! However, it also includes those that will take ADVANTAGE of their postions and those that just want to make jokes about it all! Should you have a child serving, BE OF STRONG HEART! What they do isn't in VAIN! May they come home to you, WHOLE! God Bless!

I find it very interesting how Cuyahoga County and Erie County seem to be so connected. The attorney for the Murman report was a former prosecutor for Cuyahoga County. The judge that sentenced EB to prison for 8 years was from Cuyahoga County. All these senile retired 80 year old judges that are "fixing" cases here in Erie County are from Cuyahoga County and Lorain County. Something sure does smell.......

Let see. Corrupt judges. Corrupt police. Corrupt police. What a star chamber our halls of (in)justice have become.

This is too good to pass up...A Sandusky prosecutor claims that a County Recorder is required by law to file everything that ATTORNEYS give her to file, no matter how DISHONEST and ILLEGAL she knows the filings to be. A female Sandusky police chief then gets fired for "dishonesty" based on the Murman Report, which is an investigation done by ATTORNEYS.

How is it that a retired judge from Lorain and is the vice president of business development for a law firm he is employed by is picked to hear the Nuesse case. This same law firm located in Avon has an office in Sandusky, boy does this smack of bias. Which way does anyone think this will turn out. Bets anyone.

...is if you work for SR or are a hacker. Either way you are breaking the law. I have forwarded this on to the FBI on behalf of all SR bloggers. Thanks! Please reply so the tracers can get their fix.

If I were hated as much as Baxter and Iscman seem to be in this community, I think I would just step down......

Hey Matt, at least get the Judge's name right! It's Joseph Cirigliano, not Richard!

It appears like the Sandusky Register just might be banned from printing anything else about the railroading of Kim Nuesse. Maybe so the Lorain Journal can print exactly what the GOB's want? Which makes me wonder if the GOB's really believe that Westerhold and the SR are responsible for all the OUTRAGE that is coming from this community? I don't think so. I think the Nuesse case INSTEAD is the straw that finally broke the camel's back....

C'mon tough girl where are you? You want to talk stuff? Where are you? You're such a tough girl, until you get called on something, then you back off. Just like a punk.

Anonymous

???? Wow, That one suprises me. Or...are you just being sarcastic?

Anonymous

????Oooops,,, the 007 part didnt show up...

Haha

How do you like that Matt?? The one judge you didnt want to see is picked and there is nothing you can do about it!!! LOLOLOL!!!! So now you see your worthless comments make no difference and if anything you are a detriment to the "Nuesse Camp". I love when things happen that you dont want to happen....so you love when people write hateful things about you on here because you know people are actually reading your sad column. I am sure it is because people like to read the sad pathetic writings of a little school boy who has a crush on someone who wouldnt give you the time of day other wise. Are you having flashbacks of high school when the cheerleaders always laughed at you while you were writing about sports instead of having the ability to actually PLAY. Now here we go again, doing all you can to impress the hot blonde EX police chief, who thinks youre nerd.....now soon she will be gone.......I think the T-House is hiring dancers, make sure you tell her....

Anonymous

What???? That is ALL the SR reports on anymore....what are you talking about?? Who knows what they will do when this all does blow over, which I am assuming it will SOMEDAY!!!

Lorain Journal is a better newspaper ALLAROUND anyway....better reporters, better writing, better sports...

I can honestly say that I have never encountered a more vicous, hateful person in my life as the one that made the last two comments. There's a new book out that can be found at Borders at the Mall. It's called 23 MINUTES IN HELL by Bill Wiese. For your own sake read it.

The city of Sandusky is dead, leave it to the thugs and drugs.

Way above the national average as far as the crime index is concerned. (FBI Statistics)

A school system that always fails to meet state indicators. 4 out of 30 or something like that.

Hundreds of homes for sale/rent along with falling property values.

Terrible leadership...too many examples.

Poor job creation and a shrinking tax base. Among the state leaders as far as public assistance and unemployment.

Dozens of registered sex offenders all over the place.

A police department that is constantly over worked and under fire from the community.

Crack heads and heroin/meth addicts wandering around misbehaving.

Unsupervised children whose parents could care less about them walking the streets at all hours of the night.

Abandoned homes destroying property values on just about every block.

Loose pit bulls getting shot by the police.

Couches and weight benches on porches.

Litter all over the place....except wahsington park.

etc etc etc etc

SANDUSKY: A NICE PLACE TO VISIT IF YOU HAVE MONEY, BUT YOU WOULDN'T WANT TO LIVE HERE.

Is Law director Don Icsman the president of the Good Ole Boys Club? Every time something happens in Sandusky the trails aways leads back to Icsman. Maybe its time to get rid of Law director Don Icsman.

we need to promote more breeding between the hispanics and the afro americans in sandusky. create a generation that is too lazy to steal. clean up our streets

It is really sad to see what my hometown has turned into. We left a few years ago while we could still get something for our home. It appraised for over 85K and we were happy to get 60K for it. Funny thing is, the house was a block from the waterfront.

Should have been primo property right? Nope not in Sandusky. Meigs Street and all those that run into it are quickly turning into the worst part of town. Check the daily log. How many times do you see E. Monroe, Madison, Jefferson, Adams, and Market in there? Then add the streets that run North and South and you get Perry,Warren,Franklin, Huron Ave and yes..... Hancock.

I am pi$$ed of as all get out with the leadership of Sandusky for allowing what were once nice neighborhoods to turn into the hood. I called down to the City Building constantly to complain about various things and nothing ever got done. I took pictures of run down houses and the activity that was taking place to the housing department. I called the police to report crimes. I wrote letters to anybody that would listen. Finally, we just stopped trying/caring.

It would seem to me that Sandusky has bigger problems to address. The problems is, everybody knows it and nothing ever gets done.

The Nuesee haters complain that their comments are being deleted. Thank you SR for deleting them.

I will agree with your assessment of our community, but only to an extent. Our community is salvagable. It took years for things to get as messed up as they are, and it'll take years to fix it. The marina district is a step in the right direction, so long as development continues to spread throughout Sandusky once the waterfront has been developed.
