Kevin Baxter will testify this month in the Kim Nuesse civil service hearing, and I expect he will allow the cameras to roll when he does. That would be the best way to assure residents get the best and most complete information on this important topic.

I’m hoping we’ll be able to livestream his testimony at sanduskyregister.com. That coverage gets underway again Dec. 15, when the hearings resume for two days. You have to respect the “justice delayed, justice denied” strategy the city’s crack Cuyahoga County legal team has adopted.  The delay-delay strategy means these hearings could go on for many more months. When the evidence does not favor your agenda, stall, stall, stall.

The county prosecutor already has acknowledged numerous inaccuracies in the statement he gave to Murman investigators, although he has not been specific or explained why he changed information in their $22,000 report. I stopped counting at a dozen inaccuracies when Baxter had that deer in the headlights response to my questions. That probably won’t work so well under cross-examination.

The stories Baxter told the crack investigators about two specific meetings with Nuesse appears intentionally misleading when contrasted to what other participants in those meetings recalled. Of course, that’s just the opinion I reached after reading Baxter’s witness statement and then talking with those other participants after the $22,000 Murman report was released. Those crack investigators never bothered interviewing any of those witnesses who could have provided them more complete and accurate descriptions of those meetings. Did I mention the bill for that report alone was $22,000? The cost to date for Nuesse-gate, including the tab for civil service hearing, is likely approaching $300,000.

And another thing, it’s not personal for me regarding Phil Frost. He might very well be the top cop in the nation. I just don’t think making a false criminal allegation against your boss – that goes nowhere and is disproved at a civil service hearing – is good police work, even for a bad cop. It's also a newsworthy topic. Will there be any followup? Will the city be investigating the false criminal allegation. It would be "super-crazy," to quote Phil, if it did not get reviewed.

Defamation and character assassination???? Westerhold and bloggers have done worse than that to city leaders and SPD. Maybe they can go after Nuesse and Westerhold for starting (and continuing) this mess! They defintely made it worse with half truths printed. Gesh, defamation or character assassination....THE NERVE.

So you think there is NO WAY Nuesse or Bailey can drag SPD officals into another civil trial personally? You must be delusional. Come on! They training you receive as a LE officer should tell you ANYONE can be brought to public trial for ANYTHING. LE is made exempt by qualified immunity for arrests as long as NO civil rights were violated. They are NOT exempt from PERSONAL civil suits, frivolous or not.

BTW, tell me, why is it that when a citizen of Sandusky makes a comment and doesn't agree with Westerhold, Nuesse or their supporters, they automatically say they are a police officer? I am not even CLOSE to being an officer or a family member for that matter. I do not care for the way the SR and Westerhold are treating our city, city leaders, or our officers. Is that a sin?

Dude - you're wrong if you think this hearing is the end of Nuesse's line.

Regardless of the outcome of this kangaroo court, she still has a pretty compelling claim of gender discrimination and retaliation. Somehow I don't think a federal jury will be none-to-impressed with the Murman report and the parade of half-wits and half-truths that seem to be all the City has against her. And those sued can be both the City (under Title VII) and certain high-ranking officials (under 42 USC 1983 and 1981). Qualified immunity won't apply to discrimination and/or retaliation - or conspiracy to commit both.

So yea...absent a settlement, this is a legal battle that can last long long after this silly hearing is over.

Let Donnie Iscman interpret that however he wants - but if I'm a taxpayer, I don't need a crystal ball to see that this was one expensive episode of the GOB's club - one that the insurance company is not going to keep paying to defend.

Talk is cheap. The threat of a lawsuit does worry anyone who told the truth. Keep spewing because they are not worried one bit.

I do NOT want anyone to sue SPD officers personally. But, it is a possibility. A civil suit involving USC 1983 will NOT be heard in Erie County. The 6th District is held in Toledo and jurors will be selected from the eight counties. Not from Sandusky. It is just a possibility. I want this hearing to be over with so SPD can get back to:1. Selecting a qualified and full time chief of police. 2. Begin serving the residents of the city like they are supposed to without distraction. 3. Be able to patrol the city without being accused of harassment. 4. And addressing crime issues. The command structure is currently weak as there are no captains. Most of the officers and detectives want stability and be allowed to do their jobs. It is as simple as that.

While SPD wants this mess over also, everything is running smoothly right now. If you talked with the officers, you would know that. The department is moving forward and will continue to do so until a new chief is put in place.

One doesn't normally put their best hitters at the end of a line up. Same principles rule in trial work. You may be right that these witnesses will do better than the goof ball police officials who started off - oh yeah, and the illustrious Mr. Murman and his report - but I hardly think there will be any contact with the ball, much less a base hit from any.

Does the SR realize that this is a non-story any more? This story has been on here and only 87 comments in 8 days. No one cares any more. Move on, we have other news stories that need covered.

CM Kline says that Nuesse was told by you that the city commissioners were out to get her. You said you knew of no such plot by the city commissioners, yet you have consistently lead the readers of the Register to believe just that!!

So what are you going to do now? As I see it if you admit that you lied then, you lose what very little credibility you have left. On the other hand if you say that Nuesse lied then you look like a reporter that is not interested in getting the facts and still lose creditability for blindly backing her; at the same time you would then be forced dump your support for Nuesse just to save your own neck!!! Or I guess you could just say the Kline lied under oath!! I wonder which one you will pick!!!!

Does someone else have the same notion as I, but it looks like Kevin is a drunk. He has the same coloring that someone does who has a long history of hitting the bottle. What do you think?

The way I see it is that she is unable to demonstrate an ability it takes to hold the job she was hired and then fired to do. Her ability to delegate authority in a fair and honest way has shown through. I hope that she seeks another avenue when it comes to a career, I feel this will follow her wherever she travels. From the story I gather she was afraid of Crandall and what he was suggesting to her, which from my view was that he caught her not fulfilling her job. She on the other hand should NOT have been afraid of her position if she was sure she did nothing wrong. She ouwl not have ran to Westerhold to gain an allie, but would have been professional and SMART enough to sift through her problems democratically. I do not feel sorry for her. She deserves to be washing dishes somewhere.

Why is it that Westerhold and the handful of Nuesse supporters stoop so low as to make fun of someones looks? I don't get it. I have never heard of anything so childish in my life. I don't think Mr. Baxter is bad looking at all....jealous? NO...I am not Baxter...BEFORE you go there. That's old too. Everytime someone has an opinion other than Nuesse supporters, it just has to be a police officer, family member, spouse and so on. Definitely not true.

I must admit, at least Matt Westerhold ADMITS his biased against the SPD. It was certainly very clear. I do appreciate his honesty and truth in printing his position instead of everyone speculating. On the bad side, I was relying on Westerhold to report the hearings in an objective manner. He is entitled to his opinions just like I am. But, in order for me to determine my propensity of the truth, I must be given fair and objective reporting. I can see Jason Singler is reporting this, but there will always be a suspicion of ambiguity because of Westerhold's position with the paper. Kevin Baxter has ALWAYS been honorable and truthful with me. He has proven to me to be the best prosecutor for Erie County. I always expected him to move up in politics. He has aged well compared to many others. Kevin has managed to remain in shape and stay fit. Not very many can attest to that. I do respect Kevin Baxter's testimony and hold it with cogent efficacy.

I agree Keven Baxter, has been truthful and his testimony suggests that the significance of his differences with Nuesse were professional and exaggerated by the City to justify firing her. She was well within the scope of her authority to withdraw from the drug task force as all but the Sherrif's office had done before her arrival. It was not wrong to do a warrant sweep in Sandusky, just because the Sherrif and prosecutor's office thought the offenses weren't important enough to enforce the law.

One of the commenters on here made the remark that perjury is a criminal offense. No, it isn't. Not in Erie County, anyway. I know an attorney that flat-out lied under oath in an Affadavit that was filed with a Summary Judgement, documented proof was then filed PROVING he lied----and the Erie County Common Pleas Court ignored it. I know another attorney from the same firm that lied about EVERYTHING in the Summary Judgment and once again documented PROOF was shown that it was all lies----and once again the Court totally IGNORED it. They not only lied to protect their thief client from criminal acts they lied to protect criminal acts by their own law firm. So if LAWYERS can perjure themselves with the full approval of Kevin Baxter and the Judges (two anyway) then the same should be held with everybody. (FOLLOW THE PRECEDENT)
