UPDATE 12:59 p.m. — Visiting Judge Dale Crawford and Ohio Attorney General Mike DeWine shared the details of the grand jury findings during a one-hour press conference Wednesday morning.

Crawford said the grand jury inquiry found 19-year-old Jacob Limberios accidentally shot himself in the head on March 2, 2012, and the jury elected not to consider criminal charges against anyone.

DeWine detailed the investigation by his office, including obtaining opinions from two independent forensic pathologists that found Limberios was shot on the right side of his head, shown by beveling revealed in the multiple autopsies conducted on the body. Ohio Bureau of Criminal Investigation scientists also conducted tests on the gun that showed 30 percent of the time, it could be fired without the trigger being pulled.

No criminal charges will be filed in the case.

The civil lawsuit the family filed against Sandusky County coroner John Wukie will move forward, as Jacob's parents work to have the ruling on his death certificate changed from suicide to accident.

Ohio Attorney General Mike DeWine will hold a news conference on the second floor of the Sandusky County Courthouse this morning "to announce the results of the special prosecution and BCI investigation into the March 2012 shooting death of Jacob Limberios."  

The news conference is set to start at 11 a.m. The courthouse is at 100 N. Park St.

This was addressed in the AG's report:

"To account for the bullet entering the ceiling, Jake would have likely needed to have his head tilted to the side, toward the muzzle of the gun, regardless of which side the bullet entered. If Jake was taking a reactionary, defensive posture because someone else was pointing the gun at him, generally speaking, his head would have been angled away from the gun, not toward it. However, if Jake were scratching his head with the muzzle of the gun, as two of the witnesses stated in various interviews, he likely would be tilting his head down, toward the muzzle, aligning with the trajectory, the positioning, the path of the bullet through his head, the witness statements, the physical evidence, and the majority of forensic pathology reports."

When they mentioned the bullet being shot in a downward direction, they were referring to the trajectory in reference to the anatomy of the head, not "toward the sky" vs. "toward the ground." The bullet entered closer to the top of his head than where it exited.

Got tired of seeing it everyday on the front page of my hard copy. One hundred articles is overkill, but it sold papers and just like TV ratings the the bottom line is the almighty $$$.

The ruling is what I've been saying from the get go. Dr. Phil did them no favors and it didn't pan out for anyone; to put that much information out there in the national spotlight during an ongoing investigation.

Of course, now I'm sure the AG's office will NOW be accused of being corrupt, or some other conspiracy theory.

It all falls back to what I stated when it was fist told that the A.Gs office was appointed by this new judge to investiage , I stated that due to the time that has passed by , and eveidence that was lost of destored the A.Gs office would just be spinning there wheels . Its shame that someone just might get away with murder and that justice will not be searved , But honestly , I didnt think it would .
My heart goes out to the family as well as friends of Jake and hope that someday someone will come clean with the real story about what had happend and Justce will finally be served .I dont blame the A.Gs office , cause they could only base there findings on what they have found .

He made some good points and some questions went unanswered. Long story short, all this could have been resolved with Sandusky County changing the death certificate. Pretty sure that's how this whole deal started. Everyone said it was accidental the whole time. Now countless dollars have been used, thousands of man hours used, and a family tormented. Not only tormented by their sons death, but all the negativity some brought to the table. They deserve better than what Sandusky County offered them, I will never blame them for searching for answers. Hope they can heal and move on. My opinion is, it was an accident, no matter how, it was an accident.

They didn't. The final decision was up to the grand jury, not the AG's office. The AG did offer an opinion on the matter:

"Dr. Wukie, Dr. Whaley, Dr. Baden, Dr. Beisser, Dr. Di Maio, and forensic anthropologist Julie Saul all state that the entrance wound was on the right side of Jacob’s head, which is consistent with the witness statements and with Jake being right handed. Drs. Wecht and Whaley were the only forensic pathologists to opine that the manner of death should be ruled homicide. However, neither of those doctors had all of the investigative material and evidence at their disposal at the time they rendered an opinion. Furthermore, Dr. Whaley indicated that his opinion was preliminary, while Dr. Wecht told our investigators that he was not going to 'protest' which was the entrance wound and which was the exit wound."

So, they did not in fact ignore the findings of those experts - they simply found that those experts were the two minority opinions in a group of eight, and furthermore, that they did not have access to the same amount of evidence as the others due to their being hired by the Limberios family and not as part of the official state investigation.

Looks to me like these "experts" didn't even follow the accepted standards that everyone wants Sandusky County to live up to. Just saying seems like they did more damage.

Look at the person that the state hired, Dr. Damaio was hired by the Zimmerman team. That doctor literally wrote the book on forensics, I think I believe the state over an attention hound.

I agree. Heck if I was one of the those people I would be suing the family for trying to wiretap my phones. I am sorry, but you only hurt yourself by using illegal investigative techniques. What would have happened if they said "Man I can't believe we got away with killing that kid", the answer it would have been thrown out so fast your head would spin.

Now, while I disagree with the techniques, I don't feel that the family was trying to fabricate anything. So let me get this straight, two NATIONALLY RECOGNIZED pathologists (Cyril Wecht does not fall into that category, sorry), a coroner in a major city that sees her fair share of gunshot wounds, all say it happened one way. The people opposing their view are a local doctor and a paid "expert" that refused to turn over photos of the autopsy to the AG. I am sorry but it is time to let go, there is nothing there.

Dr. Da Maio addressed the lack of stippling, and he literally wrote the book on hand gun wounds. Dr. Baden, an accomplished pathologist in his own right, agreed with the findings of Dr. Biesser (Sp?) of Lucas county. Why would these two men have any incentive whatsoever to manipulate their findings? What do they stand to gain? You claim the Lucas County corner was part of the "Boys Club", what is your excuse now? That two experts from far outside of the state and it's politics are part of the Sandusky County "Boys Club". Give me a break, do you all hear how unbelievable that sounds?

Rather than let the facts be the facts and the outcome is based on that, the mindset here is the facts be screwed my explanation is correct.

6 out of 8 EXPERTS said it happened just as those young people said it did. Just because you don't like the decision doesn't make your opinion right. The investigation done by the AG had ALL the puzzle pieces and put it together and presented to the Grand Jury. Now if you have any first hand knowledge or were an eye witness to this, please feel free to address those with the proper authorities. If the family can accept the decision, so should you. To Matt Westerhold, keeping with the theme of your recent opinion piece as to who should apologize in this Saga, are you or the Register now going to apologize to the three individuals who witnessed this terrible accident? You heard the attorney for the AG’s Office specifically say that all three of these witnesses fully cooperated with the investigation, yet the Register falsely reported several times that one or more of them were not cooperating. Also, you heard the AG himself say that these witnesses’ statements were all consistent with each other and with the evidence as to how Jake died, yet the Register, in more articles than I can count, kept reporting that their statements were inconsistent and all but convicted them of homicide. So I ask again, are you going to apologize? Whether you do or not, they certainly deserve an apology.

First off, I want to give my heartfelt condolences to the family and friends of Jake. They have spend almost the last 2 years fighting for what they think was right. Many sleepless nights, and many more to come. I pray for all involved they find comfort. Secondly, I want to thank Matt Westerhold and the Sandusky Register for their continued support and coverage of this tragedy. They also should be commended for keeping it in the spotlight and making our government give us the answers we deserve, and keeping the pressure on. Lastly, I want to make a comment to Sheriff Kyle Overmeyer and the Sandusky County Sheriffs office and to the County Commissioners.... What a bunch of incompetent, mismanaged, and untrained people, an absolute disgrace and embarrassment you have brought to the people of Sandusky County. Your lack of unprofessionalism, was highlighted on national media, and shows what a lack of self discipline your office has. Lets not forget Dr. John Wuike too, he also had a chance to make right, and refused to. You have brought shame to your name that cannot be disputed !!! Sheriff Overmeyer, you can start by taking lessons from Erie County's Sheriff Paul Sigsworth, a truly dedicated, honorable, trustworthy, and compassionate Sheriff.... The way it should be. Well said Joe Schmoe. The only thing that I would like to add is a very sincere thank you to Mr. Mike Dewine and his staff. The family has deserved the dedicated, relentless investigation that the Attorney General's Office provided. Kudos to Mr. Dewine for his professionalism and tireless search of evidence. Hopefully the Sandusky County Sheriff's Office and elected/appointed Sandusky County officials learned from Mr. Dewine as well.

I believe its very unfair to accuse the Register for covering this tragedy as they did. They had legitimate concerns and questions which many people had, and I'm sure many still do. The press keeps in check those who have unlimited power to destroy anyone who they dislike. I personally felt and still do that those in charge of this case were sloppy, arrogant, uncaring, proud and thought they were god almighty in attitude. Look how they wouldn't even answer questions on the case, and I consider they treated the family rudely!

What the Register did is what the press is suppose to do, continue to report and ask questions until they're answered to satisfaction. They serve (for profit) the community and the community wanted answers and accountability and because of the Register we forced the AG to do his job as well, instead of their constant aggressiveness towards business in collections, at least DeWine did his job, Montgomery was worthless. Sadly, we will not get the accountability part towards those in Sandusky Co. in their treated concerning this case from its very beginning.

I seldom agree with Matt politically and other wise, I have been banned by his organization a few times, but in this case he did what is expected of the press and was the only one who had the guts to ask the tough questions.

I continue to agree with Matts open letter to the judges and investigators. Even though the report was in their favor, I still believe they were arrogant and severely lacking professionally, and they should be held accountable for these actions.

The Register continually stirred the pot. Without all the facts. They were sloppy in their own right. The paper and the friends posted way too much information ( "hints" by implying or inferring things) in the paper (site) and ALL over social media. They should have had more common sense.

They should have pulled back, but, they were too damn busy trying to go after any and all LE. Hell, Matt even tried to go after the funeral home people for discarding the clothing during his questions.

The Register and the family friends had a wonderful opportunity to educate the public and run a series of gun safety articles. To make people aware. That didn't happen.

Humbly disagree with your post because there were questions, and the prosecutor would not even attempt to answer, if I recall he walked away when asked questions. This produced a flag for many.

Second, the bullet in the ceiling question. The AG determined that he tilted his head, seriously? If so, where are the gunpowder burns along with the residue?

I don't think there is anyone who knows and the AG and GJury did the best they could do with the evidence that was REMAINING.

I still believe the powers to be were sloppy, extremely sloppy and should loose their jobs.

If blame is put on anyone for this cost don't put it on the citizens and Register, place it where it belongs, ON THE SHERIFF, the investigation team, prosecutor and coronor. If they didn't do such a terrible job in the first place we wouldn't need the AG and GJury to get involved.

Lastly, your complaint about the costs of them isn't valid, this is why we have these in place, to protect society from abuse or the lack of professionalism from those such as the sheriff, if we just let them do what they want and however they want then we will have chaos and crimes from authorities towards citizens. Our liberties and protection is not free,and this includes protection from the authorites. This isn't cospiracy, its a fact, any office that isn't HELD and FORCED into check will abuse its powers at some time, I've experienced it, you probably haven't because you seem to think there wasn't a need to force a real investigation. The residue question was answered, maybe not in the way you like, but it was answered.

Why didn't it come to light that Jacob had a habit of handling the firearm in an unsafe manner? It was proven in the video that he did. Why wasn't it published that he was under a psychologists care and on meds? All of that was left out.

Truth, the problem that I had with the SR covering this story is that from the start the editors were totally biased. There was NO reporting from all sides to give an unbiased opinion. Apparently the editors have a woody for the people that they disemboweled in their paper. I bet Mr Henry is laughing his a$$ off at the people that kept these articles going.

I have a Colt 1925 Police Positive model .38 special revolver. The Police Positive part was made so accidents did not happen.

And really, all one has to do is open the cylinder and watch the action while pulling the trigger. I find it hard to believe a newer model .357 magnum doesn't have the same safety feature?

From what I read it did have a transfer safety, it just malfunctioned. Still handling a loaded firearm and pointing it at anything but it's intended target (if there is one) is very unwise. Another case of youth and inexperience, how tragic an outcome.

PEOPLE....give it a rest! Time and again there has been Grand Jury findings with the same results. These juries have been made up of different citizens that have came to the same determination.

I have to disagree that all the signs should come down. Justice for Jake and Ella means being able to look people square in the eye and say without argument that Jake's death was not a suicide, it was an accident! If you go way back to find the root of the Justice for Jake and Ella campaign, it was ALWAYS to simply have the death certificate changed so that Ella would never have to think that her daddy committed suicide. As the Attorney General stated multiple times in his explanation, there is absolutely zero evidence to support that this was a suicide. Wukie, for the love of God, change the death certificate to reflect accident, NOT suicide! Do the right thing! Then, and only then, we will finally have Justice for Jake and Ella.

So for the family to have peace from this tragedy the difference they must accept is; their son wasn't troubled, and did not commit suicide but he was reckless enough to cause his own death. Now everyone should allow the family to grieve in a proper manner and stop the media circus for nothing more than increased circulation and bias against certain government agencies.

I don't buy it either, maybe if the grand jury had ALL the evidence, oh yeah it was never collected or it was destroyed. Dewine excused the terrible investigation as a mistake to be learned from. Voters need to make sure the incompetent don't make another mistake when someone lost their life. Then let them learn that way jobless.

Are there rules or catergories in which the cause of death on the death certificate must comply with? For example, if you were killed in an accidental avalanche and eventually found to suffocate while under the rocks does the certificate read "crushed by avalanche" or "suffocated" or "accidentally suffocated by avalanche?" Seems to me that if it was a self inflicted gun wound that could read accidental suicide, suicide, or self inflicted gun wound. I shutter to think what McGookey's bill is going to be for all this... I have seen him run up bills on foreclosure cases and then leave the clients with no results and a high legal bill

I have a question for Wukie - If a person gets in a car and is in a one car accident because the car is faulty, is this also suicide or is it an accident? There was no intent to kill oneself but it was an accident. How is that any different with an unintentional gunshot that the AG deemed it was? WHY would he NOT change the death certificate? All of this, only to have the coroner say he won't change the death certificate?

Here's how it's different. From the Fremont News-Messenger:

"Dr. Gregory A. Schmunk, president of the National Association of Medical Examiners and medical examiner in Polk County, Iowa, told the News-Messenger last summer a suicide ruling might not be inaccurate if Limberios shot himself."

"It is a complex question," Schmunk said. "If a person is playing around with a loaded weapon and puts it to his head, I would call that a suicide - predictable lethality and actions by the decendent."

"But if a person was cleaning a gun, for example, Schmunk said he would likely rule the death as accidental."

So Dr. Wukie is following a set standard that is used industry-wide. You can disagree with the standard. But it's not fair or accurate to try to discredit the coroner for applying this standard to this situation, as it was done so appropriately, per the outcome of the grand jury investigation.

Thanks for the explanation - I do appreciate it.
I guess whether Dr. Wukie went to the scene that night is irrelevant but an autopsy should have been done, and as Mr. DeWine said. “What we learned from them, it would be prudent to do the autopsy.”
I believe he also said hindsight is 20/20.
