Limberios family files suit to get answers about death

A Castalia family has taken legal action against Sandusky County officials who ignored their questions about the death of 19-year-old Jacob Limberios.

“I just filed a complaint against (Sandusky County Coroner John) Wukie and his official finding on the cause of death," attorney Dan McGookey said Friday as he drove out of Fremont. “It’s satisfying — we’re going to get some answers.”

McGookey, who represents Limberios' family, filed the civil suit late Friday afternoon in Sandusky County Common Pleas Court. It demands a judge take another look at Limberios’ death.

McGookey said for months he's been trying to get Sandusky County authorities to voluntarily reexamine the facts around the death and conduct a more thorough investigation, including an autopsy.

You are so correct about McGookey making people loose their homes. I am one of them. I was lied to from the beginning they never did what they said they were going to do, but promised me all kinds of things. His stupid column he writes every week makes me angry, sure wish I could write comments on that. I am now having to file BK because of the lies.

Mr. and Mrs. Limberios, I hope you find the answers to your questions. If it were my son, I too would seek to find the truth. It is shameful the way you have been treated by Sandusky County officials.

OK investigation 101 if the victim supposedly was handling the gun with his opposite hand when the shot was fired, was their gun shot residue on his opposite hand.

Thank you for your thoughts surrounding the case, however the loss of another parent would be more way more detrimental than good for the child. While the mother may have some rough edges, her heart has always been in the right place. Her daughter means the world to her and she does anything she can do to comfort, support and protect. Her daughter is the center of her world and I would not have it any other way. Don’t assume to know her until you have spent time with her and see how she interacts with her daughter. I have been around here enough to say this, how much time have you spent with them?

The one question that seems not to be answered by any of these stories is "what end result does the family want," and "why?" Always assume a gun is loaded, if you pull the trigger you're intending to shoot a bullet. Wherever the bullet goes, your intent follows it. If you shoot it in the air and it comes down and kills someone, that is murder. If it goes into your own head and kills you, that is suicide.

Do they want the finding changed so Jacob can be buried in consecrated ground?

Does the family think someone murdered Jacob?

Does the family think someone put the bullet in the gun after Jacob thought it was unloaded? (always assume a gun is loaded).

Could it be there was a life insurance policy that wouldn't pay out for suicide and the parents are trying to profit off of their son's death?

The end result is what one of his friends got on here and stated in a previous article. It all boils down to money. His insurance policy won't pay off because the death certificate lists the cause of death as suicide. I'm sure if the cause of death would have been listed as anything else where the insurance would have paid off, their would be no lawsuit. Please be assured I am not criticizing the family, funerals are expensive, so once the dust settled I would be a little upset if this happened on top of the trauma of losing a family member to a stupid mistake. The death certificate should have never had suicide as the reason for death. Reading the facts, the events do not support this assertion. It should have been listed as accidental-Gun shot wound. It sounds to me like he was just goofing off with the gun and didn't realize it was still loaded.

The end result they want is the truth of what happened to their son. Officials should have at the very least talked to the family and explained why they ruled the way they did.

I do not know this family or why they are looking for answers. I can only guess and being a parent I would guess they would like their granddaughter not having to think that her father intentionally took his life. Besides Life insurance will not pay for suicide. Because they would like for their granddaughter to get the life insurance does not make them trying to profit from his death. Yes you should always treat a gun as being loaded but you were not there just like myself and can't say what happened or the reasons behind it but for you to imply it is sucide since he didn't treat it as loaded is ridiculous. 1. the intentional taking of one's own life.

2. destruction of one's own interests or prospects: Buying that house was financial suicide.

3. a person who intentionally takes his or her own life.

Everyone that was there has pretty much stated he did not intentionally take his life. And his family is trying to get though this and have some closure along with taking care of their granddaughter and her mother.

Just an FYI I was the girlfriend of Jacob, and the mother of his daughter. We are filing a legal suit not for money, but for answers. If anyone has read the previous articles we have many questions and concerns about how sandusky county conducted their investigation. Many, many inconsistant statements have lead us to this point. We are trying to get answers in what happened that night and after many months of being ignored by all authorities involved it has finally led to the point where it needs to go into legal hands so Sandusky County can never make the same mistakes to anyone or family again. As for Dan, he cant help everyone, but he sure does give it his all to try to. I know he has put his all into jakes case! Dan Mcgookey has been by our side these last 8 months helping us so Sandusky County can be held accountable for their mistakes made in this investigation. As for taking care of my daughter, I am doing a fine job by MYSELF, if you have any questions or concerns involving this case or me as a mother feel free to contact me personally!
