The last few moments of Owen Barker’s life were horrific.

So says Sandusky police, tasked with investigating the 3-year-old  boy’s murder Monday evening in a Fulton Street home. 

The Lucas County coroner’s preliminary autopsy report, released Wednesday, indicates the child sustained multiple blows to his small body. 

He was “beaten by another person,” the report states.

Police believe the assailant was Michael Milner, 24, who was entrusted with watching Owen that evening while the boy’s mother was at work.

Milner is being held in the Erie County jail on $180,000 bond, on charges of murder, felonious assault and child endangering. 

A complete list of the injuries shows Owen sustained heavy internal and external bruising to multiple areas on his head, lungs and abdomen. He also suffered internal cuts to his intestines and the base of his liver, as well as scrapes on his face, head and penis, according to the autopsy report. 

The report states the injury that killed the boy was a puncture to the top of his heart, likely caused by blunt force trauma — essentially a fatal blow to his torso.

In a recorded 911 call Monday evening, Milner is heard telling a dispatcher that Owen was injured when he tripped on a toy truck.

But the autopsy report also documents something else about Owen’s body: bruises from injuries sustained days or even weeks prior to the injuries that caused his death.

Erie County prosecutor Kevin Baxter said the boy’s mother, Danielle Flannery, 22, has retained an attorney.  

Milner is Flannery’s boyfriend, although he is not the father of Owen, police have said. 

Officials at the Erie County Department of Job and Family Services, meanwhile, said they did everything they could to help Owen after an incident last year, also involving Milner.

Newly released documents show county social workers investigated Milner on Aug. 19, 2011, after getting a report of abuse from Ashland County.

The report was made by Owen’s grandparents after they discovered bruises on the boy’s buttocks and scrotum while they were babysitting the toddler, who had just turned 2 years old at the time. 

Social workers saw the boy the same day the report was filed, Erie County Job and Family Services director Karen Balconi-Ghezzi said.

“By the time we saw it, the bruising had gone to the yellow stage,” Balconi-Ghezzi said. “It wasn’t substantial enough for charges.”

Sandusky police then interviewed Milner and Flannery, according to a police report.

During the interview, Flannery told police Milner had spanked Owen when she was at work.

“She stated Milner caught Owen climbing out of a second story window. Milner then gave Owen a spanking,” the police report said. “She said she does not think Milner realized how hard he hit Owen and she was sure he did not mean to harm Owen.”

Days later, Milner admitted to police that he bent the toddler over his knee and spanked him after catching the boy trying to go out the window.

“Milner said he feels horrible about the incident and did not mean to spank him that hard ... he did not mean to hurt Owen,” the report said. “Milner said he will never spank (Owen) again.”

That’s where talk of charges ended.

“There’s spanking and then there’s spanking,” Balconi-Ghezzi said. “If there is a break in the flesh or serious damage to the body, then it rises to the next level.”

After the interview, social workers were convinced of Milner’s regret.

“Everything seemed to indicate that they were a caring pair of people that wanted to make sure it never happened again,” Balconi-Ghezzi said. “The child was non-verbal at the time.”

Other than filing charges, the only thing social workers could do was separate the child from Milner. But that would have required an emergency removal order.

To obtain that the county would have had to convince a judge that Owen was in “imminent danger,” and that’s not what the facts showed at the time, Balconi-Ghezzi said. 

Rather, social workers saw the event as an opportunity to talk to Flannery about her situation.

“We offered daycare services and parenting classes,” Balconi-Ghezzi said. “At that point, it’s up to her.”

Erie County prosecutor Kevin Baxter said he has reviewed the case and determined that social workers are in the clear.

There’s a “huge movement” for agencies to respect the unity of a family, Baxter said. 

“You cannot just go in and take the children away without a really good reason,” Baxter said.

He pointed to a 1999 case where social workers at Erie County Job and Family Services tried to separate a man from his children after he spanked the kids.

After he was acquitted of child endangering charges, “Richard W.” sued to get his children back. In the end, the court of appeals ruled that the county had overstepped its bounds.

The court not only granted custody to the father, but came back with a fiery condemnation of what social workers had tried to do.

“Normally, our analysis of the case would end upon our making that determination,” a court mandate said.

“We cannot, however, put this matter to rest without stating ... this court has been shocked by the behavior of (social workers) in this matter.”

The rebuke also seemed to be aimed at the fact that the involved boys, ages 3 and 11, were forced to undress multiple times in front of female social workers.

Baxter said there is no legal restriction on the age a child must be before a parent can spank them — even if the child is a 2-year-old.

It just has to be done in a  “reasonable” manner, Baxter said.

 Reading todays paper I am more convinced now that Baby Owen suffered abuse over a long period of time............................How can a child be spanked so hard that his buttocks and private parts get bruised? The list  of injuriesin the autopsy and noted in the print edition of todays Register were many................How could the Mother of this child not know this pos was not abusing him? Doesn't make sense and, although I'm sure she loved this child, she didn't care enough to remove him from harm. She should face charges as well.

 I can't say I'm shocked that the system failed this child. Far too often the concern is "respecting the family unit". What about when the family unit is far too broken? Just because somebody can reproduce doesn't mean that they should have. There are plenty of people out there that could have raised this child appropriately and he would still be alive and have the opportunity to grow up into a fine upstanding young man. Even if he would have survived his little life. He really didn't have much chance being raised by these morons.

The mother needs to be charged with neglect for leaving him with the boyfriend and accessory to murder for staying with the moron when she knew he was harmful in the first place. Here's your newsflash honey. That is your child, your only responsiblity in this world is to provide for his well being and safety. That is what you were put on this earth for. If you couldn't handle that then you needed to give that little boy to somebody that could.

Was there anyone OTHER than Milner who saw the child trying to climb out the window? ..or was that just Milner's "justification" for spanking the baby?  How low to the floor was the window sill?  I've seen some only about 12 to 18 inches up, but otherwise - how would a 2 year old be able to get up to the window sill to be in danger? 

At 2 years old children are inquisitive, incredibly mobile, they'll try anything (at least once) but the trying doesn't justify spanking hard enough to cause ANY kind of bruising.  I've raised boys - 9 in all, counting nephews etc. - so I'm familiar with their anatomy ... and spanking even an energetic squirmer NEVER put my palm in contact with their testicles .. by the way, I never spanked more than 2 swats and never hard enough to even redden the buttocks, let alone leave bruises. 

Milner has obviously been abusing this child for quite some time.  His "justifications" are NOT convincing to anyone who took the time to THINK about what he was saying - whether it was plausible or possible - and he was believed because Mother WANTED to believe it and apparently the authorities went with the LETTER of the law rather than the INTENT. 

May the grandparents and father find peace, I'm sure Owen finally has, altho that's not much consolation for having lost him.

I have read the paper again. I'm upset with Children's Services they should have kept on with the constant watch over the so called boyfried. I was in the ER that night when Owen was brought in and let  me tell you it was heart wrenching. When we left the family was outside waiting for someone to come. To make a long story short they should put Mike Milner in general population and see what happens to him. There may be robbers and thugs in jail but they do not like child abusers of any sort

Let me just say I do not know any of the people involved....But, up until this article I was not quite sure what to think about this situation. But now with all these new details released it is obvious to me that he is guilty of brutally beating this boy. It was not an accident. And it was not some type of medical misdiagnosis as others have proclaimed! And until now I also felt sorry for the mom. NOT ANYMORE! She should face charges also. However I still believe that Children Services also are guilty of dropping the ball on this case! Such a tradgedy! Poor little guy. May he rest in peace and justice be served. Prayers for the rest of this poor baby's family.  This story breaks my heart!

I notice it is quieter on here....not so many "supporters" for the guy who was charged!

Well back when I was younger Social Services returned me back to my dad.  I was in a very loving, caring, God Fearing Family!  Social Services told my foster mother that my problem was "I was loved too much"  I WAS 4 YEARS OLD!!!!!!!!!!!!!!!!!!!!!!!

 For some reason this case haunts me.  Words cannot discribe what this child has had to endure.  I guess as a parent I just can't comprehend this.  I would move heaven and earth to protect my baby and I would want an answer for every bruise found on his little body.  

It truly breaks my heart and the ONLY good that has come out of this is that this precious child will never have to suffer or be hurt again.  He sure could not count on the adults in his life to protect him.  I have read all the face book pages and none of the adults in Owen's life appear to be model citizens. As for Children Services...what were you thinking????  Mike really seemed sorry for what he had done??  Did you just close this case out or did you do ANY follow ups.  I realize laws bog things down but come on!!! Somebody has some explainin' to do for sure!  Lot's of somebodies.

 READ THE REPORT ON WHAT HiS INJURIES WERE...3 years old having his Life beat out of him and a$$hole people thinking he fell on a truck...believing that nonsense is a sin in itself the report CLEARLY states he was beaten by another person and only two were in the apartment ...it's not rocket science it's cut and dry...this guy however wonderful people want to claim beyond a reasonable doubt did this.how can some of you people forget that precious child had a horrific ending to his life for what? What can a 3 year old possibly do that would warrant a beating that severe? A previous report says he spanked the kid on his rear so hard he bruised...for being on the roof..does anyone see the problem with a 3 year old being on the roof ? Would that happen if responsible parents were watching the child? Probably not..that report is so heartbreaking how can some people have no heart? Or have the audacity to cheapen this tragedy? The more details that are shared, the more immense this tragedy becomes. We pay people to work for children's services to hopefully prevent these things from happening; I've known people to have their children taken away for much less. Spanking a two year old until his little rear and privates are bruised should have been a sign to remove him from the home. I don't care if the bruises were turning yellow or green or any other color; they were there. Climbing out a window...sure...just like he got all those other injuries from falling on a toy truck! Cover your butts is what the county is trying to do...in part they are responsible for believing a druggie...give me a break! He was crying on the phone when he called 911 too but he only called 911 after someone saw him carrying the lifeless baby out of the house...wonder where he would have taken him if somebody hadn't seen him carrying the child. We see too much of this in the news nowadays; missing children found dead. The truth is, is the most abuse to children is done by people they know and are supposed to be able to trust. This child was failed by the system and by his own mother. Details from the autopsy prove he had been abused prior to this and his mother...main caretaker...didn't see any bruising on his poor little body? Maybe she chose to believe every bruise on this precious child was an accident or deserved because he did something wrong because her boyfriend said so? No child deserves to be beaten and/or bruised. It is a mother's duty to protect her children. The first sign she had of her b/f abusing Owen should have been the last; he should have been tossed out. I can only imagine what this innocent little boy had going through his head every time his mother left the house and he was left with this abuser. Thank God he is in a better place now. No more bad decisions on the part of the county or his mom. Gotta also wonder if the mom and the boyfriend were tested for drugs...of coarse, it's too late for that now. Maybe children's services should have thought about that one of those times they were called out to investigate. I felt sorry for the mother before this autopsy report but she is as guilty as he is for being an enabler, in my opinion. Jesus is singing Owey a lullaby tonight and I know he feels safe in the Lords arms.

So with that all said and done, its  not the County's fault.   Everyone involved should be ashamed of themselves.  If they really think they did their job in this case then who needs that service.  It's pointless.

Again the system fails a child.  When are we going to learn that the rules we make fail the child and protect the adult. We worry about the adults right and do not worry about the consequences of our actions, putting the child in jeopardy. 

There is nothing we can do to bring this child back but maybe we can keep the next one from dying.

When the FIRST bruise in noticed....I don't care what color of that bruise is,....the child is removed until a completely satisfactory explanation is given. PERIOD.....then we wouldn't be looking at something as tragic as this. The child is placed with a safe and responsible relative or adult until such time as that happens. 

I don't care how loud the adults scream and yell, the alleged parents don't get them back until a suitable house is established. If the "hitter" is there, the child isn't.  So be it. 

This cannot go on.  Call it "OWEN'S LAW".  Call it whatever you like, but it is simple and it doesn't need and act of congress to impliment.  The lawyers don't need to screw it up with a bunch of legal talk and grease, just simple as can be.  No mumbo jumbo. 

That way, no fuss, no muss, no death.  Because obviously people today do not get the difference between discipline by spanking and beatings.  Its just too late for that.  People today are too savage.  So just be simple about it and do this. 

That way no child will get killed by some idiot who cannot control his own impulse to swing his fists.

Did you read the article?  They cannot take children from a family just because of minor bruises.  The law won't be changed.  Every kid in the area would be in foster care if bruises were a definite indication of abuse.  Kids get bruises all the time from other things.  I don't think anyone saw this happening to Owen in advance, even his mother.  If she had, she might have done something different.  Judging them after the fact is useless as is condemning the system.

@wiredmama, so you are advocating the removal of any child that may have a bruise on their body?  A little overboard don't you think?  If we removed children from their parents just because they have a bruise, every child in the country would be stripped from their homes at some point in their lives.  Also, as far as I know the Constitution still offers equal protection under the law, and the fact that you are innocent until proven guilty.  There is no way around this, taking a child from the home for just "having a bruise" and then requiring the parents to "prove" it wasn't malicious would quickly be ruled unconstitutional.  The burden of proof is on the state, meaning they have to prove that evidence exists that a crime may have been commited, hence the need for a warrant from a judge.  A simple bruise likely wouldn't meet the burden of proof.  Knee jerk reactions are never the answer to lifes problems.

 In this case it wouldn't have been overboard look at what were commenting on ...a lot of young parents do hit their kids out of frustration what's wrong with a little more in-depth investigation if it saves kids? Rather be safe then reading about a 3 year old being beaten to death...of course kids get bruises but if children's services is brought into it tjere is obviously reason there should be thorough investigation. Turn someone in for abusing their children and CS will go ask them if they need food, or any kind of help. Parents who abuse their children need help alright ...... not in the form of food though ..... more along the lines of public floggings. They think physical punishment is such a great idea .... maybe they are highly lacking in physical punishment themselves and we should be kind enough to give them what they lack.

Just  a few weeks ago, multiple posters commented on another article that "the real problem" is that the State won't let people spank their kids...that you risk having charge filed against you.  It just isn't true.  Kids may threaten that and ineffective parents may fear that, but it isn't the reality. The sad truth is that children have very few real protections and rights.  They may be over-indulged and over-empowered, but their rights are very few in the face of physical, sexual, psycological harm.

@Unassumer, what do you mean "you don't think anyone saw this happening to this baby in advance, even his mother"?  Maybe you should read the article, because it states the grandparents filed a report after they found bruises on him while they were babysitting him.  CPS saw the child that same day. 

My opinion is that CPS dropped the ball and allowed this child to fall through the cracks.  I don't care if the bruises were yellow, black, blue or purple, sounds like there was enough of them that didn't occur just from basic child's play.  And, given this monster's history and the fact he's been investigated by CPS in the past, they should have looked into this child's case more thoroughly and made sure he was in a safe environment.

As for the mother, it's obvious it was more important for her to have someone in her bed instead of making her baby her number one priority.  She would have to be blind not to see the bruises and other injuries on this baby, not to mention he certainly had to have been in some kind of pain from all the abuse he received.  I hope that she also has to answer to charges of child endangering, neglect and maybe even accessory to the crime committed on this child.

This is a sad outcome that has shaken the Sandusky community to its core, I just hope this precious little boy has a proper burial and we can all rest in the assurance he is among angels now.

Boy they sure do, Ohioan.  But it is not only Ohio.  I have traveled all over this country and everyday in that newspaper you read about these terrible things happening to children.  I can no understand how any attorney can defend these people.  I realize everyone has "a right" to be defended and some people are not guilty as charged.  But these actions against children that are so so so obvious.  It seems that laws are made for the criminals.  Prayers go out to little Owen.  My heart breaks as I love all children and animals.

First, I feel so sorry for this poor little boy!!  It seems that the grandparents were the only ones looking out for him.  I wonder if they stayed in contact with the family after they reported the bruises.  I wonder if the mother stopped talking to them all together after authorities were contacted?  After reading everyone's posts and the articles, I feel that Children Services shouldn't be totally held responsible for this child being murdered as everyone says.  I had a friend who used to work for Children Services and I guarantee they take their job very seriously.  And I have to believe they followed their procedures.  We are quick to place judgement on them in this case and then quick to bash them when they do remove a child.  I believe they have one of the toughest jobs!! 

I'm curious about all the people close to them, in their circle.  Did friends or neighbors ever see anything worth reporting?  And the mother, what was she thinking?  If another person "disciplined" my child in a way that caused bruises, there is no way I would ever trust them again.  I fired a babysitter because she was going to put liquid soad in my 3 years old mouth.  That was her standard punishment.  As a mother, it is my responsibility to protect my child!!  If I don't believe in putting soap in my son's mouth, why would I be ok with someone else doing it?  If I don't believe in spanking so hard that you leave bruises, then why would I let someone else do it?

Ultimately, I feel the blame has to go on the mother and only the mother.  If there were other bruises, she had to have seen them.  Seems like she is the only one who knew what was really going on and didn't do anything about it.  Shame on her!!!  She let this happen!

Let me get this straight: Because the bruises on the little boy — including on his genitals, for pity's sake! — weren't fresh enough, there wasn't anything to be done? And the person who admittedly CAUSED the brusing said he wouldn't "spank" the boy again, so the case was effectively closed? Really?

For the record, as a child who WAS spanked, and as someone who HAS spanked a misbehaving child, SPANKINGS DON'T LEAVE BRUISES. Sure, there may be some red skin for a short while afterward, but that's the extent of it. And those red marks are on the child's BOTTOM, not on his or her genitals! This sounds a whole lot less like a REASON from Child Protective Services than it does an EXCUSE!

And yeah, I can't pretend I'm surprised that mama is lawyering up. I'm hoping she NEEDS the lawyer after charges are filed against her, too!

SamAdam:  You're right...spanking does NOT leave bruises!  Especially, when that child was most likely wearing a diaper!  Even if his story panned out and he was spanked because he walked onto a roof...why was that child released to a home where he could walk onto a ROOF!  For gooness sake!  If nothing else, the grandparents should've been given temporary custody until the home was safe!

 The location  itself of the bruising last year, would have sent up and SHOULD have sent up a RED flag.  Big time.   To everyone.  How does a little 2 year old  bruise his   S cro  tum  like that?   I have a feeling he was yanked off the  potty  and hit the guard.   Or he was hit with a belt  with the buckle end.

Heads Should Roll! This is BS! Maybe in a perp friendly childrens services there was not enough to take action. In the previous regime Englehart/Voltz, this NEVER happened. All those who complained that children shouldn't have been removed now understand why they pushed to always protect the child. The County is at fault here, whithout a doubt if Englehart/Voltz were still running the show this NEVER would have happened!

I'm sorry, but I feel that children services definitely dropped the ball here! There is NO way a 2 yr olds bottom should be bruised from a "spanking", let alone his genitals!!!! It's not like this child was 90 yrs old and had it hanging thru the cracks so to speak! There's absolutely no way a spanking would cause bruising there! A bruise there would of more than likely occurred from a punch or a hard pull! And with the autopsy results showing injuries down there, I think this creep enjoyed torturing him in this manner. I raised several boys, and with ALL the falls on to the bars of bikes, kicks to the groin etc.. NEVER once were genitals bruised!!!  I hope the caseworker is able to live with her/himself, as I know I wouldn't be able to.

 

I hope when "Mikey" goes to prison, the guards put him in the yard, turn their backs, and the other inmates use his junk as a punching bag!

 

My heart just breaks for you Owen! I am so sorry you were put in this situation by the person who should of loved and protected you with her life, and was kept there by those who are paid to keep you safe! RIP Sweet Baby!

He was 2 when the first incident was reported.  I feel pretty stupid because I wasn't even thinking about the fact that was most likely wearing a diaper.  This makes the whole "spanking" story even more tragic.  What did he use?  Makes you cry thinking about what this poor baby endured!!!  I'm not accusing but wonder if the mother also abused him.  Again, how could you ever leave someone with your child that did something like this?  My heart is breaking.......

Balconi-Ghezzi said. “The child was non-verbal at the time.” .....  non verbal,  read that again everyone ..... NON VERBAL. When a child is "non verbal" NOTHING can be proven in the eyes of the courts, unless it is terriblt severe. WHY must children suffer.

In other words ..... someone would have had to fight for baby Owen .... but who cared? Obviously no one. Can we fight now? Please? For the Children? I don't know what we can do, or how to start, but something HAS to be done. Please don't forget this little boy or what he endured at the hands of those who were supposed to protect him.

 I am usually not one to judge. I am one to give the benefit if the doubt, but this is all wrong, all the way around. I try to think about what she may be going through, losing her precious little boy, allegedly at the hands of her boyfriend, who she just moved into a new place with. I see both of their facebook's and I see a mom who seemed to be happy to be a mom. I see a selfish, wha, wha boyfriend, who didn't seem to be going anywhere but nowhere. I do not understand, with everything going on, why she feels the need to be on FB, changing her relationship status, accepting new friends. Is that really important for the world to know at this point? I would believe there are other things she needs/should be attending to, much more important things. Everyone handles things differently, but I do not understand this. A child is murdered and life goes on, on facebook? huh? If I were her attorney I would counsel her to not be posting anything, to stay off Facebook. It is highly possible the heat is going to come down on her legally, she best get prepared. This is not going to just go away. The world will not let it.

This sickens me that poor baby, I have known Mikey since birth and he has always had serious anger issues. He was very abusive towards his twin as well as a older sibling. You would think someone would have tried to get him help long ago with his anger issues this could have been prevented. His parents if thats what you want to call them were occupied with other things dealing cocaine, weed and who knows what else around these kids When they were together. Not role models at all. His father has a extensive criminal record including violence as well as drugs. that apple didnt fall far did it. Mikey was always talked about as the bad twin and they thought it was funny. there are alot of people that should be feeling very guilty over this tragedy, you always hear (we would have never thought he would do that) but then look at his history is it really a surprise his temper finally seriously hurt someone? not to me it isnt. What a POS

Why does it seem to take such a tragic event to get everyone involved???? I did a little research and found a eerie similarity in another case involving a 4 yr old boy Dominic Calhoun he was beaten to death by the hands of get this his mothers live in boyfriend. The Killer as well as the little boys mom are now in prison. This ripped out the hearts of everyone who knew this baby as well as alot of people who never met him. There is now a Law in the state of Michigan called Dominics Law geared toward protecting these babies when they cant protect themselves.His bio father and grandparents pushed hard to get this law on the books. Congrats to them. Owen is gone and as tragic as it is we cant bring him back. The next step is to get legislation passed to give the social workers the laws to protect these babies and if they fail to protect them hold them responsible. As well as MANDATORY DEATH PENALTIES to these monsters. (Owens Law) start the petitions I will be first to sign my name. LETS NOT FORGET to pressure prosecutors/District Attorneys to not plea bargain but to go at these monsters with no restrictions. Dominics Law is not a big fix but it is a huge step in the right direction

As much as I am outraged by the death of an innocent child, the Sandusky Register has given us no less than four days of stories, with the greatest impact upon the alleged suspect.  There will, most likely, be a jury trial and it is a concern when media coverage of the event could possibly influence and/or taint a potential pool of jurists.

 Hang them. The mom because she obviously didn't care for her childs safety by leaving him with a drug addict for a babysitter.  The boyfriend should be put to death now so everone can move on and go back to pretending things like this dont happen everyday.  Erie County is one of the worse counties in the state for allowing kids to endure physical abuse.  Truth is if that kid lived in Huron County or several other counties he would have been pulled out of there months ago just on the drug use alone.  If he lived in a defferent county he would still be alive.  Erie County JFS owes this City the life of a little boy.  I hate the idea that Erie County JFS will probably give more children a death sentence in the future and just brush this one off.  Case workers are improperly trained as to what warrants the removal of a child from a home.  They go by what Erie County has always done.  Truth is other counties are pulling kids out of homes and saving lives everyday.  I personaly believe that if the parents are drug addicts that those kids need to be removed on the first offense.  If the parents want the kids back they should face strict drug testing.  Truth is if someone honestly cared about their kids they wouldn't be a junkie in the first place.  GET THEM KIDS OUT OF THE DOPE HOUSES ECJFS!   As a city we will find someone to care for them.  I will pay for that and Im sure everyone else will not mind either.

 Michael Wasserman was murdered by his mother's boyfriend, Craig Popke, in 1990. This is very similar to that murder, the mother, Peggy Wasserman, was also charged. Have laws changed that the mother cannot be charged?

How many here commenting have ever been spanked, or spanked their own children?  Let's be honest.  I'll start........nope, never, ever!  Riiiiiiiiight!  I would be a liar to say I've never been spanked, or spanked our children.  However, there is a huge difference between a spanking on their lil arses and a beating!   By the way, I've read many a comment from bloggers regarding past articles where they approve of "corporal" punishment, be it in the home or the schools. The lack of it, well,  It's "what's wrong with kids today".   Don't know about anyone else, but if anyone was gonna strike our children, it better be us, not someone somewhere else.  The last time I spanked our children, they were 10, 8 and 6, and it was for doing something that was dangerous.  Toddlers/young children will have a tendancy to explore!  It only takes a moment of taking your eyes away, and something tragic can happen!    

This is just food for thought..........When listening too the 911 audio, I see a picture of the home is up.  He spanked him in the past for trying to get onto a roof. It left bruises and he was questioned.   Fast forward......he told the Dispatcher he fell onto a plastic toy. He was tthen asked how far.  He responded "from his height".  A 3 yr. old is what, 3 ft. at the most?  Could Owen of fallen out of a second story window, maybe the only one that looks like it's open, and landed onto the concrete porch and steps below?  A 20 ft. fall  would explain the blunt force trauma and internal injuries, the head injury, the abrasions.  Could he of lied about how/where he fell?  Maybe I'm just thinking this, well, because I just cant fathom someone beating a child in such a manner, although the reality is that it happens on a daily basis. As well, to think it couldn't/wouldn't go on in the homes of "model" citizens.....think again!   By the way, someone had commented as to when it became open season on children...........since the dawn of Mankind!  It's the most vulnerable that are used, abused ,  taken advantage of.  Children fall into that category, along with the elderly and the disabled!    

As for Children Services.......they were living their own dysfunctional, abusive drama last year.  Maybe they all were a tad bit pre-occupied?  We got to read all about that, which of course ended w/the Director being fired and a new one appointed.   So please, let's not make excuses for their dysfunction and  neglect within their own Dept.t!   

This is a tragic story!  One  I'm cutting out to give to a co-worker who chooses not to rec. the SR and knew nothing of this story.  One  who'se son has joint custody of his 2 yr. old daughter and is going through some of the same circumstances w/the whacked Mother and her whacked family!  He lives a couple of hours away and is at his wits end as what to do to protect his 2 yr. old daughter the other 3.5 days she is in her Mother's custody. 

In all honesty,  if he did beat baby Owen..........should someone had done something like this to one of our's,........not that I would follow thru, but I would be a liar to say that  I wouldn't want them to stop breathing, NOW, having it be  the result of my own hands! 

Rest in Peace Baby Owen!  May the truth be revealed.  Thoughts and prayers are with you!

  On July 30, 2012 at 7:25 p.m., the Sandusky Police Department responded to 521 Fulton Street, lower apartment, to assist the Sandusky Fire Department (SFD) on an EMS call. Officers learned that a 3-year old white male had been transported to Fireland’s Regional Medical Center by the SFD.

According to the mother's facebook page, they had just moved into this apt recently. So, there was NO DANGER of him falling from 2nd floor.  This poor baby died the horrific death the coroner said he did.

erie county child protective services did NOTHING for my children.  I was going through a divorce and I noticed bruising on my son. I stopped the visitations immeditaely and  I called to have a home inspection for my ex and even with teachers calling and reporting the bruises and his school counselor calling , plus I had a police report,  I was told "his father would have to render him unconscience before we can do anything"  I told the "gentleman" on the phone that I was trying to prevent that from happening and filed a cpo on my own through the municipal court and did not allow my children to have unsupervised visitations with their father ever again. 

R.I.P. you sweet little angel and I pray for swift and firm justice and the maximum punishment for those that caused your death.

@ truth or dare.  No problem.  I think we all would like to think this was some sort of horrible accident.  I, for one, have cried with every article I have read on this poor baby.  Unfortunately, I believe the evidence is pointing directly at the monster who took this baby's life in the most unimaginable way possible.

@knuckledragger and others who do not understand what it takes to "bruise" a child's buttocks and genitals:  Have you any idea what force it takes to bruise a child's buttocks and genitals until they are black and blue?   So much so that several weeks later they are just turning to the point that they are just getting healed?  This is NOT a normal spanking people.  Someone applied a great deal of force....and probably not with a hand.  It was with an object of some sort....a spoon or a belt.   It takes a GREAT DEAL OF FORCE. 

That kid would have been crying very hard and very loudly.  Someone must have heard him....the neighbors no doubt.  But they probably were used to him crying given his little body's condition at autopsy. 

A beating is FAR different than a spanking but many of you do NOT know the difference and for that I feel sad for you AND for your kids.  God help them if you don't know the differnce.  A spanking is done with the hand, not with a weapon.  It isn't done with your full force coming down on a child's backside.  That is a beating.  Even a Supreme Court Justice said he couldn't explain child abuse satisfactorily but he knew it when he saw it.....well here you see it.  This is the perfect example of it.....take a goood looong loooook.  This was child abuse and it went unchecked.  Why?  Because BRUISES like this were not GOOD enough to remove a child.  COME ON.....they should have been.  The man ADMITTED  he hit the kid and said "I won't do it again.".   I would have had that child out of there so fast it would have had your head spin.  Law or no law, he would be coming with me.  That is exactly why I am not a social worker.  I couldn't stand there and see that and see that guy and believe him for one minute.  NOPE. 

Knuckle, you asked me do I think it is over the top?   Not in this case, not with this guy....not wth an admission that he hit that child.....not with healing brusies like that.....(ex nurse in me)....no way.....That child would be removed.     That is why I suggested " OWEN'S LAW". 

"OWEN'S LAW'-----any deeply apparent bruise on a child's legs, buttocks or arms, chest or back that appear to be from a beating or wrenching brought on from an adult or another sibling older than the child sustaining the injury shall be removed from that house until an investigation can be completed to the satisfaction of the court system and children's services.  If it can be observed by the social worker, the child is immediately removed.  No question asked.  A police officer will remove that child immediately.  The child shall remain in the custody of relatives or the court until such time as the investigation ends.  No lawyer shall intefer with or change this law from the simplicity of this law as written herein. 

It is that simple.

I agree. Why would Baxter say there's a "huge movement" for agencies to respect the unity of a family? That wasn't a family ---- that was a live-in boyfriend that should have been arrested on the spot when the grandparents reported the bruises on that little boy's buttocks and genitals and the dirt bag admitted to it.  How in the world can the Erie County Job and Family Services ever justify allowing that child to remain in the same house with that trash after the first incident?

After reading this I TRULY FEEL there SHOULD BE A TOTAL OVERHAUL of the ENTIRE DEPARTMENT OF FAMILY SERVICES ....ESPECIALLY in the CHILD PROTECTIVE SERVICES division!!! My niece was being mistreated by BOTH of her parents and the school called children services on my sister and her husband.....my sister whom is a MASTER at lying convinced the social woker that she and her husband had done NOTHING wrong and that worker LITERALLY told my niece to stop being a liar and that her aunt's should keep their noses out of her parents business......THESE are the PEOPLE who are SUPPOSED to PROTECT children like this precious little boy and my niece.......

I pray for strength for the grandparents and other family members during this difficult time...as for the mom...I'm sorry BUT there is NO WAY this woman DID NOT know this man was abusing her child that SEVERELY and as far as I am concerned she should stand trial right along with him for not PROTECTING this precious little boy from this man.....just MY opinion.....

Spanking is ok, beating in anger is not.  Spanking does not leave bruises, it makes an impression on a child.  Any bruise is suspect and needs to be watched.  How about Owens Law that demands regular physical exams by a hospital after a child is reported bruise.  Seems like little Owen would not have died if some of the abuse was detected before the fatal beating.

The problem with spanking is that it is hitting, and when done in anger, can get out of control. A squirming screaming toddler can be tough to deal with and someone who lacks self control to start with, for whatever reason, could seriously hurt or kill a small child. It is heartbreaking to read about babies and children who have been killed or permanently damaged at the hands of  someone who was unequipped to deal with them. Both of these people (the mother and the boyfriend) should NEVER be given a second chance to have children. They should be sterilized and forbidden to ever watch a child. He may be in prison for quite awhile, she may just get a slap on the wrist and go out and have another one next year, who knows. Poor little Owen never will.

Now, I have something to say about the people that say 'Mikey' didn't do it, he wouldn't do it, it's not like him, he was clean for a couple weeks now...to the ones throwing around bible verses

This POS murdered this little boy. He started to do the right thing by taking him to the hospital then he realized, oh sh$$, they're gonna know that I did this, so there comes the running in circles in the driveway.

Mr. Fredericks tried to help and I thank you for that. You are experiencing grief and this could be considered a trauma, I'm not a doctor, but my advice would be to go get some grief counseling, it may help you.

For the a## that said the 3 year old started it, wow is all I can say. I sincerely wish 'Mikey' would have started with me in that apartment. He would have internal, external, and blood in every room on the ceiling and on the floors...everywhere because he would have touched everything in that apartment.

I would have calmly sat down, smoked a cig, drank a soda and then walked to the hospital and told them to call the police and the ambulance because there is a guy that just fell over a toy truck and hit his head.......

Not to mention,  he then,  would have walked into an iron skillet, a  Louisville slugger and  tripped  over a couple  of flights of stairs.    oops.   

Oh and I  would have drank  a nice hot  cup of  tea with honey and lemon ( sinusitius),  and   afterwards enjoyed a lovely stick of Dentyne gum.    :)
