Man pleads guilty to taking nude photos of teen boys

A 71-year-old Sandusky man pleaded guilty Monday in Erie County Common Pleas Court to allegations of photographing nude boys in his apartment.

A 71-year-old Sandusky man pleaded guilty Monday in Erie County Common Pleas Court to allegations of photographing nude boys in his apartment.

James S. Gallagher, 300 block E. Market St., pleaded guilty to eight felony counts of pandering obscenity involving a minor, according to court documents. Dismissed were 10 additional counts of illegal use of a minor in nudity-oriented material and five other counts of pandering obscenity involving a minor.

He was arrested Jan. 29 after a 16-year-old Sandusky boy and a 15-year-old Huron boy told police Gallagher had been photographing them in the nude for the past year in exchange for money, police said.

The photographs — thousands of them going back three or four years, according to Sandusky Det. Sgt. John Orzech — appear to have been taken in his apartment.

Gallagher agreed to being classified as a Tier Two sexual offender, requiring him to register every 180 days for the next 25 years.

He could face a maximum of 12 years in prison, five years of post release control and be ordered to pay restitution to the victim of $40,000.

Gallagher is scheduled for sentencing on Feb. 10.

This man should be prosecuted to the fullest extent of a law he should be prosecuted for every illegel act and not one charge should be dismissed.  The judicial system including the prosecutor should be removed from office, this man should be removed from the streets and should receive a life sentence for the crimes he has committed. And I consider that to be a very light sentence, but I'm sure that his boy friends in prison will hold him accountable.

 16 year old boy.....money for pics....according to many posters in support of Mrs. Seville (Perkins teacher) who was involved in a sexual relationship with a 16 yr old this guy should be shown leniency....

Come on. He faces a 12 year sentence. He's 71. Do the math. He likely WILL get a life sentence! And R U Kidding is right. He could've killed a teen-ager instead of photographed him, and I'll bet his sentence wouldn't have been a lot different. What's wrong with THAT picture?

Local Resident makes another very important point. Older women who get sexually involved with under-age boys are treated much more leniently! I often wonder how much of that is due to the fact that a lot of men, probably including prosecutors and judges, and secretly wishing they'd had such "luck" when they were in high school!

It would also be nice if people remembered that the "victims" here weren't toddlers or even really young. I wonder how many of these boys were delighted to be paid to do something they didn't consider a big deal, at least not until everybody else made a big deal out of it!

I'm not saying that what Jim did was remotely acceptable. But I am saying that there are far worse people, and far worse crimes out there. Perspective, people!

Why did he plead guilty to 8 counts if only 2 boys were involved? If 10 other counts and another 5 counts were dismissed, then he was charged with a total of 23 counts. Why 23 counts if only 2 boys were involved? Why does he have to pay $40,000 restitution? Where is the rest of the story? 12 years seems too harsh for a 71 year old man. That huron guy who killed that young teen about 30 years ago only got 9 years and many muderers got far less lenient sentences. Oy legal experts sam and buff, why 23 counts?
