Sandusky County dispatcher under investigation

Sheriff Kyle Overmyer says investigation is ongoing.

Overmyer refused to provide an incident report or provide information about what disciplinary action was taken against the dispatcher, or what the suspected infraction was that prompted the investigation.

"We do not have any documentation to pass on at this time. It is an ongoing investigation," Overmyer stated in reply to an inquiry this morning.

State law requires law enforcement agencies to file an incident report before commencing an investigation, and the incident report is a public record.

Overmyer has refused to release any information and appears to be withholding the public records despite the law's requirements.

Wonder if he'll offer a financial settlement with the agreement they don't say anything bad about each other?

I don't understand how Sandusky County is above the law? How can they withhold public records? how did the SR find out someone was disciplined?

John Harville

Ha ha ha ha ha what a dumb tiger!

Cowboy

Oh that's not good to withhold public records! That'll get you fired for sure! That's against the law!

John Harville

...not if you're Kyle Overmyer. In what other jurisdiction can cops investigate a shooting but not collet the bullet or keep the clothes or get fingerprints?

Not to worry, Dean Henry will step in and be the prosecutor and defending attorney and stall until he saves the day. I can't wait until I see him making legal motions against himself and having to explain that to the court. "your Honor, I have made intentional motions against myself as prosecutor and defense council, I therefore would like to make a motion of dismissal of this case."

Cowboy

That's considered Porkiesss Corpius.

Youo mean the same Dean Henry who defended Todd Helms, for Clyde-Green Springs super... and let the rest walk?

Register enlighten us "State law requires law enforcement agencies to file an incident report before commencing an investigation, and the incident report is a public record." What section of the Ohio Revised Code directly relates to this statement while an investigation is ongoing?

You can start here. You have to read each section and each section that relates to it carefully to follow the connections. I'm pretty sure the code was written by lawyers.  You might also get a copy of attorney Dave Marburger's book, "Access with Attitude, An Advocate's Guide to Freedom of Information in Ohio." Check this amazing book out here
