Napping Perkins teacher gets another chance with court case

A 74-year-old woman who lost her teaching job for allegedly sleeping in class will have another shot to appeal her discrimination lawsuit against Perkins Schools.

The school district's administrators fired Carol Smith in 2010, after she was suspended three times — once for missing two classes, a second time for repeatedly sleeping in class, and a third time for using Playgirl Magazine as an example of yellow journalism during a class discussion.

That is why this "newspaper" is really just a tabloid....some say the press uncovers truths but I think a local blogger or someone should investigate the Register, and see how many lies or falsifications they could find.

In the private sector the sleeping is called "stealing time" and is cause for immediate dismissal. Couldn't agree more with your statement.

Anybody see the statewide school rankings today? Perkins is second lowest in the county, an "effective" school system.

She's an excellent teacher and I'm personally glad that's she's finally going to get her apapeal!! She should have never been fired in the first place. Her students didn't feel that she should have been fired, for the most part they were standing behind her and supporting her as were their parents. It was precious few that were up in arms over the "playboy" mention and they failed to mention that she also brought up the National Enquirer and Us Magazine as examples of "yellow journalism" but all anyone focuses on is the one and the sleeping incidents were blown out of proportion as well. Mrs. Smith was doing her job as well as any other teacher in the Perkins School system. There were other reasons behind her firing and everything will come to light in the appeal!!!

Sleeping during a class and not showing up for one or two is definitely a reason for being dismissed. Were there medical problems for which this teacher had notified the principal? If not, then I can see why she was dismissed.

This is my mother you all are attacking. She had notified the principal and the superintendant as well. If you don't have the facts don't vilify. She had as much a right to finish out her 35 years as a few others in the school system who were moved to other positions were allowed to. If it were not for my mother, there are more than a few students over the years who would not have graduated. She called them in the mornings, made sure they had rides and made sure they did their homework and got it turned in. I hope in some point of all of your lives you meet a woman as honest and straightforward as my mother and I am proud to call her mom.

If you would have read what Wired said you would know that she said if your mother didn't notify she could see why she was terminated. Read, understand, digest, then comment. Makes you sound a lot less stupid in the end.
As far as your mother and employment, well IMHO she was sleeping on the job. Medical problem or not she was stealing from her employers, and in the end that is the taxpayers, which I am one of.

What does the teacher's union have to do with her lawsuit? She was fired, lost her appeal, then decided to try to sue the school system for age discrimination. The suit has nothing to do with the teacher's union.

Truth or Fiction

I would like to clarify the nature of this suit not the validity of it. This is not a teacher tenure or public employee binding arbitration case. She has filed in Federal Court under the Age Discrimination Act, the same Federal Statute that protects both private and public employment. This is a suit brought by her attorney not the Union. The Register was not clear on this point.

Anyone over the age of 40 is eligible to file a claim with the Ohio Civil Rights Commission (who represents the EEOC in Ohio)if they feel they have been discriminated against because of age.
