Erie County prosecutor Kevin Baxter has gone on the offensive in the wake of a federal magistrate's recommendation that convicted killer DeWitt McDonald be granted a new trial.

Baxter said two local jury panels and numerous judges and appellant judges across the state previously reviewed the allegations U.S. Northern District Court Magistrate Judge Vernelis Armstrong relied on in making the recommendation and rejected them. He called Armstrong's recommendation an "aberration," and said he was confident the federal judge would review it accordingly.
