The Vermilion teenager charged with murder and felonious assault in a Cuyahoga County case will be tried as an adult.
The boy, who turned 18 on May 5, is accused of assaulting 39-year-old corrections officer William Hesson while in custody April 29 at the Cuyahoga Hills Juvenile Correctional Facility. Hesson died from injuries suffered in the assault. A Cuyahoga County coroner ruled the death a homicide, saying Hesson died of cardiac rhythm disturbance caused by a blow to the abdomen.
The boy will have to appear for a probable cause hearing with a Cuyahoga County Juvenile judge before the case can be bound over to an adult court, said Ryan Miday, a spokesman for the Cuyahoga County Prosecutor's office. The probable cause hearing had not been scheduled as of Wednesday.
Susan Morgan, the boy's stepmother, declined comment on the case but apologized to Hesson's family.
"My deepest sympathy goes out to the Hesson family," she said.
The Vermilion boy has a history of violence. After he was sentenced to serve time in the Department of Youth Corrections following a disposition hearing Aug. 26, the boy reportedly struggled with court officials and Erie County Sheriff's deputies. He was eventually subdued with a Taser.
Following the incident, the boy told employees at the Erie County Juvenile Detention Center that if he had taken the deputy's gun, he would have shot both deputies in the courtroom, as well as sentencing Judge Robert Delamatre.
He was charged with aggravated robbery, assault and delinquency in connection with his August 2008 court outburst. The charges are still pending.
The boy was originally adjudicated delinquent on two counts of gross sexual imposition and one count of sexual imposition in a 2007 case in Vermilion.
The boy, then 16 and living in Vermilion, inappropriately touched and exposed himself to his half-sister, who was 5 at the time. During the same time frame, he also inappropriately touched his then 9-year-old stepsister. The boy also allegedly had inappropriate contact with his then 6-year-old male cousin.
