PORT CLINTON

Despite a taped confession, a man accused of sexually abusing a young girl more than 20 years ago will not stand trial.

Clayton Russell, 71, Fremont, was indicted Jan. 31, 2008, on 48 counts of rape after a woman, now in her 30s, told Oak Harbor police in August 2007 she was assaulted by Russell between the ages of 5 and 13.

The Sixth District Court of Appeals upheld the dismissal of the case in a decision released today, citing the statute of limitations.
