Brody given maximum sentence in Put-in-Bay killing

UPDATED WITH VIDEO A Bowling Green man has been sentenced to 16 years in prison for beating another man and leaving him to die in the woods on South Bass Island last year.

Zach Brody, 27, appeared for his sentencing in Ottawa County Common Pleas Court on Wednesday afternoon.

His parents and the parents of the victim, Phil Masterson, 25, of Westlake, made statements to the court about how the Sept. 5 death has affected both their families.

The two got into a fight during a weekend at Put-in-Bay which resulted in Masterson losing consciousness. Brody dragged Masterson's body into the woods, took his wallet and identification and left him there to die.

Brody agreed to plead guilty to involuntary manslaughter and two tampering with evidence charges.

In exchange, a slew of other charges were dismissed.

On Wednesday, Judge Bruce Winters sentenced Brody to 16 years in prison, the maximum time he could receive.

The Winter's are all as slanted as they come....what's in it for me....maybe I'll let you...  Perhaps the Judge would prefer to be beat to death...or his family as he is supposed to be the eldest stateman in the county...(another feather in the cap for the county - not!)...then have his ID taken from his body and left. If this is justice...I can assure you if someone kills anyone in my family I'd have to take it into my own hands...not a fake death penalty...ohhh that's right it's only 16 yrs...my G.D. children are older than that. If you're good enough to kill someone you're good enough to give your own life. Sorry son you deserve something much more.

Here's a newsflash.  The judge doesn't give out plea deals the prosecutor does and the judge in court basically said this was a rediculous plea deal and should have been life so get your facts straight before you attack someone.

Is it just me or does it seem like courts any more are all about plea bargins? Bring back of the days of "you do the crime, you are going to serve the time!"

This is just crap, I thought Ottawa County was one of the toughest in the state. This kid got off easy. Plea Bargin my butt, this is a joke and the prosecutor is a even bigger one. This guy will walk free in 16 years maybe sooner and might just happen to do this again. The joke is on the county because they did no justice at all. Plea bargin, get a grip.

It is a sad case of man vs man. It's understandable how a lot of drinks and a fight can end up in this manner but when one finally becomes sober how a man is left ot die. Just hard to believe how this Brody could just leave this man in the woods to die a panful death. No person deserves that kind of treatment how ever much you hate them. I could not even do that to a dog or cal let alone a human.

I hope in the 16 years he sits in prison he can at some point say he is sorry to the dead man's family and he was wrong. Will not bring back their son  but it could help in the healting.

Wish there was some easy answer to get across to those like Brody how bad it is what he did but he may never ever realize that.

Thoughts and prayers are with both family as both have lost.

This guy only gets 16 years for beating another man and leaving him to die in the woods. A disbarred attorney gets 8 years for calling a corrupt old rent-a-judge corrupt. What's wrong with this picture?

Did Brody INTEND to kill Masterson? Doubtful. But did Masterson die as a result of a brutal beating administered by Brody? He sure did! I realize that that doesn't meet any kind of criteria for a pre-meditated first degree murder charge. But how does it NOT warrant murder? "Involuntary manslaughter?" Really? You mean somebody FORCED Brody to beat Masterson? Somebody held a gun to Brody's head and MADE him hide Masterson in the woods to die? Somebody threatened Brody with severe repercussions if he called for medical help for the obviously badly injured Masterson? As far as I can see, there's nothing "involuntary" here!

Yes, it's prosecutors that determine potential plea deals. And no WONDER the defense jumped at it! I actually sympathize with somebody who does something stupid but without malice, even when it results in somebody else's death, This? This was all but inhuman. At least the judge imposed the maximum! I sincerely hope some bleeding heart somewhere doesn't let Brody out early. This sentence seems to me to be the LEAST he deserves!

just read the whole story from beginning to end and then form your opinion. He made a terrible decision   AFTER THE FACT to relocate the still alive body...... Masterson was pursuing brody for the fight, in such as manner he was knocking on doors in the middle of the night hunting brody down, now i am not suggesting that he deserved to die but he obviously thought he was gonna dish out an easy beatdown to brody, he was a mixed martial arts fighter with sanctioned fights under his belt and brody was to my knowledge training and aspiring to fight as well.... fill in the lines people   masterson WAS the aggressor   and he got more than he deserved or expected..... Add alcohol and these tough guys think they can whip everyone

 Put-in-Bay.....where inebriation and stupidity are celebrated .... and profitable! Who is surprised when something like this happens over there? No me. I feel sorry for the victim's family more than for the "tough guy," but killing another human being over what appears to be primarily a matter of silly pride is going to be a heavy load (in or out of prison) for this young person, now a convicted felon, to carry around for the rest of his life.

 Who is surprised?????? Everybody but you evidently. I spent 7 summers  working there and I can personally tell you that the Island was stunned by this!! It was a tragedy, avoidable, but tragic. Please dont make it put in bays fault that this kids a waterhead.

I am very disappointed that the prosecutor agreed to the plea deal. There is no reason to

drop charges. It is what he did after the fight that is most troubling. He dragged Masterson

off into the woods. The 16 year sentance should be the minimum, as in 16 years to life,

not the maximum sentence. Brody is no better than an animal for what he did.

If these two young men had not been drinking, you can bet the fight never would have happened. Now there's one in the grave and the other one has to live with it for the rest of his life --- and that will be worse than his prison sentence. Pathetic.

Just read the article in Sandusky Register.  A lacerated pancreas and his testicles bleed.  What in the hell did this guy do to him.  It sounds like stomping and kicking after he was out.  Very sad and scary.  Booze very bad for 2 kids looking for trouble.

16 YEARS??  Ha! Ha!  He will do less than 8 years and you will see him back on PIB island celebrating.  He will be a bit older, but FREE as a bird.  There is NO truth in sentencing when it comes to liberal justice.  NONE!  The judge has to APPROVE any plea deal suggested by the prosecutor.  The judge also did NOT stipulate any mandatory time.  When will be he eligible for parole?  No mention of that??  Once again, when he enters corrections, the judge NO longer has any say to what goes on.  The job of the judge is done when he issues or approves the sentence.  If Mr. Brody is a good little boy in PRISON, he is eligible for EARLY RELEASE on any number of programs.  His lawyer has already started getting him out early for his plea deal.  And justice for all.

So you're saying that at least initially that this was self-defense on Brodys part? Is this the reason for "involuntary manslaughter"?
