Sex offender residency doesn't violate probation

Violating civil law has not yet been deemed a probation violation in Erie County, according to county prosecutors.

Convicts on probation are advised to "obey all laws," said Prosecutor Kevin Baxter, although it's typically interpreted as criminal laws, with civil infractions seldom coming to light.

Ohio law requires all sex offenders to live more than 1,000 feet from a school premises. To date, prosecutors say, three Erie County sex offenders have yet to move: James Fitzpatrick, Gerald Younce and Dupri Mills.
