Man shot thought gun was a toy

Paul Burnside told the Dayton Daily News he and another person struggled with suspect Neil Moore in a break room Monday. Burnside said someone pushed Moore’s hand holding the gun, and a shot hit the ceiling. Burnside said he and someone else grabbed Moore’s arms, and a second shot hit Burnside.

Authorities said Moore warned those in the room not to “mess” with his family.

Moore is charged with an assault count and a weapons count.
